Commission Implementing Decision (EU) 2024/1956 of 16 July 2024 amending Implementing Decision (EU) 2016/2323 establishing the European List of ship recycling facilities pursuant to Regulation (EU) No 1257/2013 of the European Parliament and of the Council on ship recycling

Official Journalof the European Union ENL series
2024/1956 17.7.2024
(1) Article 6(2), point (a), of Regulation (EU) No 1257/2013 requires ship owners to ensure that ships destined to be recycled are only recycled at ship recycling facilities included in the European List of ship recycling facilities (‘European List’) published pursuant to Article 16(2) of that Regulation.
(2) The European List is set out in Commission Implementing Decision (EU) 2016/2323(2).
(3) The authorisations of Arise Recycling AS, a ship recycling facility located in Norway, is due to expire on 1 October 2024. The Commission has received information from Norway that the authorisation to conduct ship recycling granted to that facility has been verified, in accordance with Article 14 of Regulation (EU) No 1257/2013. The European List should therefore be updated accordingly.
(4) The authorisation of Sagro Aannemingsmaatschappij Zeeland B.V. located in the Netherlands expired on 28 March 2024 and the competent authority informed the Commission that the facility did not request to renew its permit. That facility should therefore be removed from the European List.
(5) The authorisation of UAB Demeksa located in Lithuania expired on 25 May 2024 and the competent authority informed the Commission that the facility did not request to renew its permit. That facility should therefore be removed from the European List.
(6) The authorisation of Ship and Industrial Service Ltd located in Bulgaria expired on 25 January 2024 and the competent authority informed the Commission that the facility is ceasing its activity. That facility should therefore be removed from the European List.
(7) Denmark informed the Commission that the facility JATOB ApS has changed name to Jatob Frederikshavn ApS and the Netherlands informed the Commission about a change in the method of recycling for Damen Verolme Rotterdam B.V. Furthermore, Kiliçlar asked to add an information in their contact details. The European List should therefore be updated to reflect these changes.
(8) The Commission has received two applications, in accordance with Article 15(1) of Regulation (EU) No 1257/2013, for Dortel Gemi Söküm Demir Celik San. Ve Tic. Ltd. Şti. and Ege Gemi Söküm San Ve Metal San.Tic. A.Ş., ship recycling facilities located in Türkiye, to be included in the European List. Having assessed the information and supporting evidence provided and gathered in accordance with Article 15 of that Regulation, the Commission considers that the facilities comply with the requirements set out in Article 13 of that Regulation to conduct ship recycling and to be included in the European List. The European List should therefore be updated to include those facilities.
(9) Anadolu Gemi Sokum located in Türkiye has demonstrated that it complies with the requirements of the Regulation with respect to the safe and environmentally sound dismantling of floating platforms and included specific procedure in its ship recycling facility plan. The limitation related to the dismantling of rigs should therefore be removed in the European List. At the same time, it should be recalled that the yards remain bound by the limit of the width of the vessels they can receive. The limit set by the width of the vessel could only be considered to be removed following the review of a cooperation agreement with an EU listed neighbouring ship recycling facility which would cover in a satisfactory way the nature and conditions of such cooperation. To be consistent with the terminology used under the definition in Article 3(1), point (1), of Regulation (EU) No 1257/2013, and taking into account the need for specific dismantling procedures, the limitations for ‘rigs’ should be replaced by a limitation for ‘floating platforms’. The European List should therefore be updated to reflect these changes.
(10) Implementing Decision (EU) 2016/2323 should therefore be amended accordingly.
(11) The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 25 of Regulation (EU) No 1257/2013,
Name of the facility Method of recycling Type and size of ships that can be recycled Limitations and conditions under which the ship recycling facility operates, including as regards hazardous waste management Details on the explicit or tacit procedure for the approval of the ship recycling plan by the competent authority(1) Maximum annual ship recycling output, calculated as the sum of the weight of ships expressed in LDT that have been recycled in a given year in that facility(2) Date of expiry of inclusion in the European List(3)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1257/2013 of the European Parliament and of the Council of 20 November 2013 on ship recycling and amending Regulation (EC) No 1013/2006 and Directive 2009/16/EC (1), and in particular Article 16 thereof,
Whereas:
(1) Article 6(2), point (a), of Regulation (EU) No 1257/2013 requires ship owners to ensure that ships destined to be recycled are only recycled at ship recycling facilities included in the European List of ship recycling facilities (‘European List’) published pursuant to Article 16(2) of that Regulation.
(2) The European List is set out in Commission Implementing Decision (EU) 2016/2323 (2).

In particular, the EPPO should be able to swiftly start its operational activities in Sweden, including in the context of cross-border investigations, notably by initiating investigations, if need be, upon reporting from institutions, bodies, offices and agencies of the Union and the competent authorities of the Member States in accordance with Article 24(1) of Regulation (EU) 2017/1939, or by exercising its right of evocation. This requires at least the appointment of the European Prosecutor from Sweden, who could, in exceptional cases, take a reasoned decision to conduct the investigation personally, in accordance with Article 28(4) of Regulation (EU) 2017/1939. To avoid that notifications are made to the EPPO while it is not able to deal with them or that time limits elapse, Articles 24 to 27 and 31 of Regulation (EU) 2017/1939 should apply in Sweden as from the twentieth day of the appointment of the European Prosecutor from Sweden in accordance with Article 16 of that Regulation.
(15) The participation of Sweden in the enhanced cooperation should be swiftly confirmed in order to ensure the timely appointment of the European Prosecutor from Sweden, which is essential for the EPPO to start its operations in Sweden. This Decision should therefore enter into force on the day following that of its publication in theOfficial Journal of the European Union.

Commission Implementing Decision (EU) 2024/1948 of 9 July 2024 amending the Annex to Implementing Decision (EU) 2023/2447 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States (notified under document C(2024) 4955)

Official Journalof the European Union ENL series
2024/1948 11.7.2024
(1) Highly pathogenic avian influenza (HPAI) is an infectious viral disease in birds and can have a severe impact on the profitability of poultry farming causing disturbance to trade within the Union and exports to third countries. HPAI viruses can infect migratory birds, which can then spread these viruses over long distances during their autumn and spring migrations. Therefore, the presence of HPAI viruses in wild birds poses a continuous threat for the direct and indirect introduction of these viruses into holdings where poultry or captive birds are kept. In the event of an outbreak of HPAI, there is a risk that the disease agent may spread to other holdings where poultry or captive birds are kept.
(2) Regulation (EU) 2016/429 establishes a new legislative framework for the prevention and control of diseases that are transmissible to animals or humans. HPAI falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687(2)supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI.
(3) Commission Implementing Decision (EU) 2023/2447(3)was adopted within the framework of Regulation (EU) 2016/429 and it lays down emergency measures at Union level in relation to outbreaks of HPAI.
(4) More particularly, Implementing Decision (EU) 2023/2447 provides that the protection, surveillance and further restricted zones established by the Member States following outbreaks of HPAI, in accordance with Delegated Regulation (EU) 2020/687, are to comprise at least the areas listed as protection, surveillance and further restricted zones in the Annex to that Implementing Decision.
(5) The Annex to Implementing Decision (EU) 2023/2447 was recently amended by Commission Implementing Decision (EU) 2024/1452(4)following outbreaks of HPAI in poultry in Bulgaria that needed to be reflected in that Annex.
(6) Since the date of adoption of Implementing Decision (EU) 2024/1452, Germany has notified the Commission of an outbreak of HPAI subtype H7N5, in an establishment where poultry was kept, located in Lower Saxony state.
(7) In addition, the outbreak confirmed by Germany is located in close proximity to the border with the Netherlands. Accordingly, the competent authorities of those two Member States have duly collaborated with regard to the establishment of the necessary protection and surveillance zones, in accordance with Delegated Regulation (EU) 2020/687, as the protection and surveillance zones extend into the territory of the Netherlands.
(8) The competent authorities of Germany and the Netherlands have taken the necessary disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around the outbreak.
(9) The Commission has examined the disease control measures taken by Germany and the Netherlands in collaboration with those Member States, and it is satisfied that the boundaries of the protection and surveillances zones established by the competent authorities of Germany and the Netherlands are at a sufficient distance from the establishment where the outbreak of HPAI has been confirmed.
(10) In the Annex to Implementing Decision (EU) 2023/2447, there are currently no areas listed as protection and surveillance zones for Germany and the Netherlands.
(11) In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with Germany and the Netherlands, the protection and surveillance zone duly established by those Member States in accordance with Delegated Regulation (EU) 2020/687.
(12) Therefore, protection and surveillance zones should be listed for Germany and the Netherlands in the Annex to Implementing Decision (EU) 2023/2447.
(13) Accordingly, the Annex to Implementing Decision (EU) 2023/2447 should be amended to update regionalisation at Union level to take account of the protection and surveillance zones duly established by Germany and the Netherlands in accordance with Delegated Regulation (EU) 2020/687, and the duration of the measures applicable therein.
(14) Implementing Decision (EU) 2023/2447 should therefore be amended accordingly.
(15) Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI, it is important that the amendments to be made to Implementing Decision (EU) 2023/2447 by this Decision take effect as soon as possible.
(16) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

Commission Implementing Decision (EU) 2024/1888 of 10 July 2024 on the Seine – Scheldt cross-border project on the North Sea – Mediterranean and Atlantic Core Network Corridors and repealing Implementing Decision (EU) 2019/1118 (notified under document C(2024) 4754)

Official Journalof the European Union ENL series
2024/1888 12.7.2024
(1) Decarbonising transport is a key policy objective of the Union. The Commission Communication ‘The European Green Deal’(2)of 11 December 2019 has confirmed and strengthened the Union’s ambitions towards fighting climate change. In this context, fostering inland waterways transport to move goods and passengers, as outlined by the Sustainable and Smart Mobility Strategy(3), is an important Union transport policy and a long-standing priority for the implementation of the TEN-T network.
(2) Through the completion of the Seine – Scheldt network, the Seine basin will be directly linked by continuous high-gauge inland waterway to the Scheldt basin in the north of France, Belgium and the Netherlands and further, to other important European waterway basins such as the Rhine and the Maas. This will create a continuous, effective and consistent high capacity inland waterway network linking the numerous maritime and inland ports of this wider European cross-border region.
(3) Through connecting France, Belgium, the Netherlands, and beyond Germany, the Seine-Scheldt network has a clear cross-border dimension.
(4) The Seine – Scheldt Network and the related Seine, Scheldt and Meuse river basins are pre-identified cross-border links on the North Sea – Mediterranean Core Network Corridor and the section Le Havre – Paris is on the Atlantic Core Network Corridor in the Regulation (EU) 2021/1153 of the European Parliament and of the Council(4). The Declaration on the implementation of the TEN-T Core Network Corridor North Sea – Mediterranean (the Declaration of Tallinn) of 17 October 2013, signed by the Belgian, Dutch and French Transport Ministers and by the Transport Commissioner, has further underlined the commitment of the concerned parties to implement it. Moreover, the Work Plans for the North Sea – Mediterranean Core Network Corridor emphasizes the need to ensure completion of the Seine – Scheldt project as the foundation for establishing a fully functioning multimodal transport corridor.
(5) One of the major objectives of the project is to ensure that the main Seine – Scheldt itineraries are at least of ECMT class Va and to secure good navigation conditions.
(6) All components of the project Seine – Scheldt are essential for its completion. Among them, the Canal Seine-Nord Europe is the main missing link, without which the Seine – Scheldt network cannot be realised.
(7) The Seine – Scheldt project is a complex cross-border project, involving Belgium (the regions of Flanders and Wallonia) and France and involving works aiming both at creating new infrastructure and at improving existing infrastructure with minimal impact on navigation. Sufficient coordination is therefore an important challenge. In order to support the coordinated and timely implementation of the project, it is necessary to adopt provisions laying down a description of the necessary actions and the timetable for their implementation. This would help achieving the cross-border and modal shift objectives of the Work Plans for the North Sea – Mediterranean Core Network Corridor, as well as to complete the Seine – Scheldt project at the earliest possible date and, in any case, by 2030 at the latest.
(8) The clear identification of the necessary actions to further implement and complete the Seine – Scheldt project and the timetable for their implementation is also important to plan and fully optimise the availability of European, national and regional funding as well as private financing. Union co-financing has a leverage effect on national and regional decision-making for the implementation of the actions.
(9) Belgium (the regions of Flanders and Wallonia) and France have already carried out significant works (studies and infrastructure works) contributing to the realisation of the Seine-Scheldt project. Most of them have been co-financed by the Union, under different funding programmes. Activities are currently performed under all related Grant agreements of the Connecting Europe Facility signed since 2014.
(10) Since the adoption of the Commission Implementing Decision (EU) 2019/1118(5), the Seine-Scheldt project has clearly entered an important new and very visible stage as main studies have been concluded. Works are on-going on numerous sites including sector 1 of the Canal Seine – Nord Europe, the reconstruction of weirs and upgrade of locks on the Upper and Lower Seine as well as the cross-border Lys.
(11) Major achievements to date include inter alia (i) the upgrade of the Upper Scheldt in Wallonia to the ECMT class Va gauge since January 2020, including the adaptation of the Tournai crossing to a one-way ECMT class Va gauge; (ii) the entry into service of new ECMT class Vb locks in St-Baafs-Vijve and Harelbeke as of August 2020, thus improving the Lys, the constituent link of the Seine-Scheldt route in Flanders; (iii) the re-opening of the cross-border Condé-Pommeroeul canal with ECMT class Va in November 2023.
(12) In accordance with article 5 of the Implementing Decision (EU) 2019/1118, a review has been carried out to update the timetable of the remaining actions.
(13) The cross-border dimension of the project requires setting up dedicated governance structures. Belgium (the regions of Flanders and Wallonia) and France closely cooperate since years, notably within the framework of the Inter-Governmental Commission for the preparation of the completion of the Seine – Scheldt project, established in September 2009. This Inter-Governmental Commission has the operational support of the Seine-Scheldt European Economic Interest Grouping (Seine-Scheldt EEIG) gathering Voies Navigables de France (VNF), the Société du Canal Seine-Nord Europe (SCSNE), le Service Public de Wallonie (SPW) and De Vlaamse Waterweg NV. The Société du Canal Seine-Nord Europe, in charge of the construction of the canal Seine-Nord, has been set up in May 2017. These dedicated entities constitute an integrated management structure that supervise and coordinate the completion of the Seine – Scheldt project. The European Coordinator for the North Sea – Mediterranean Core Network Corridor and a representative of the Commission should regularly participate in the meetings of the Inter-Governmental Commission and Seine-Scheldt EEIG as observers. Moreover, the European Coordinator and a representative of the Commission should participate in the meetings of the supervisory board (conseil de surveillance) of the SCSNE as observers.
(14) In order to monitor progress of the implementation, the Member States should provide the Commission with regular reports on the matter, concerning the sections situated in their respective territories, and notify any delays encountered. The Inter-Governmental Commission has provided a report on the progress of the implementation on 27 January 2022. This review reports also on the progress together with the necessary proposals for adjusting and further elaborating the overall timetable. The considerable effects of the covid pandemic 2020-2022 on the implementation conditions of the project have mainly led to the adapted timetable in article 2.
(15) The implementation timetable set out by this Decision should be without prejudice to the fulfilment of the requirements defined in the international and Union law, including provisions to protect the environment and human health. This timetable should allow to plan and fully optimise the availability of funding, without prejudging the financial commitment of a Member State or of the Union.
(16) Member States concerned should comply with Union environmental legislation, in particular, the provisions of Directive 2011/92/EU of the European Parliament and of the Council(6)on the assessment of the effects of certain public and private projects on the environment, Directive 2001/42/EC of the European Parliament and of the Council(7)on the assessment of the effects of certain plans and programmes on the environment, Directive 2009/147/EC of the European Parliament and of the Council(8)on the conservation of wild birds, Council Directive 92/43/EEC(9)on the conservation of natural habitats and of wild flora and fauna, Directive 2000/60/EC of the European Parliament and of the Council(10)establishing a framework for community policy in the field of water.
(17) Without prejudice to Article 47(2) second subparagraph of Regulation (EU) No 1315/2013, it is appropriate to foresee a review clause in this Decision.
(18) As the actions necessary for the completion of the Seine – Scheldt cross-border project are now set out in this Decision, Implementing Decision (EU) 2019/1118 should be repealed.
(19) The measures provided for in this Decision have been approved by Belgium and France.
(20) The measures provided for in this Decision are in accordance with the opinion of the Committee referred to in Article 52 of Regulation (EU) No 1315/2013,

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1315/2013 of the European Parliament and of the Council of 11 December 2013 on Union guidelines for the development of the trans-European transport network and repealing Decision No 661/2010/EU (1), and in particular Article 47(2) thereof,
Whereas:
(1) Decarbonising transport is a key policy objective of the Union. The Commission Communication ‘The European Green Deal’ (2) of 11 December 2019 has confirmed and strengthened the Union’s ambitions towards fighting climate change. In this context, fostering inland waterways transport to move goods and passengers, as outlined by the Sustainable and Smart Mobility Strategy (3), is an important Union transport policy and a long-standing priority for the implementation of the TEN-T network.
(4) The Seine – Scheldt Network and the related Seine, Scheldt and Meuse river basins are pre-identified cross-border links on the North Sea – Mediterranean Core Network Corridor and the section Le Havre – Paris is on the Atlantic Core Network Corridor in the Regulation (EU) 2021/1153 of the European Parliament and of the Council (4).
(10) Since the adoption of the Commission Implementing Decision (EU) 2019/1118 (5), the Seine-Scheldt project has clearly entered an important new and very visible stage as main studies have been concluded.
(16) Member States concerned should comply with Union environmental legislation, in particular, the provisions of Directive 2011/92/EU of the European Parliament and of the Council (6) on the assessment of the effects of certain public and private projects on the environment, Directive 2001/42/EC of the European Parliament and of the Council (7) on the assessment of the effects of certain plans and programmes on the environment, Directive 2009/147/EC of the European Parliament and of the Council (8) on the conservation of wild birds, Council Directive 92/43/EEC (9) on the conservation of natural habitats and of wild flora and fauna, Directive 2000/60/EC of the European Parliament and of the Council (10) establishing a framework for community policy in the field of water.
