Council Decision (EU) 2024/2687 of 8 October 2024 on the position to be taken on behalf of the European Union within the European Committee for drawing up standards in the field of inland navigation and within the Central Commission for the Navigation of the Rhine with regard to the adoption of technical standards in inland navigation

Official Journalof the European Union ENL series
2024/2687 14.10.2024
(1) The revised Convention for Rhine Navigation of 17 October 1868, as amended by the Convention amending the Revised Convention for the Navigation of the Rhine, signed in Strasbourg on 20 November 1963 (the‘Convention’), entered into force on 14 April 1967. The Convention maintains the Central Commission for the Navigation of the Rhine (‘CCNR’) and the regime for inland navigation of the Rhine established in 1815. In the framework of the CCNR, the European Committee for drawing up standards in the field of inland navigation (‘CESNI’) was created on 3 June 2015 in order to develop technical standards for inland waterways in various fields, in particular as regards vessels, information technology and crew.
(2) Directive (EU) 2016/1629 of the European Parliament and of the Council(1)refers to the latest CESNI standards laying down technical requirements for inland waterway vessels, namely European Standard laying down Technical Requirements for Inland Navigation vessels (‘ES-TRIN’). The CCNR also refers to the latest standards in its Rhine Regulations. Pursuant to Articles 22 and 23 of the Convention, the CCNR may adopt binding resolutions establishing technical requirements for inland waterway vessels in inland navigation of the Rhine. The technical standards to be adopted by CESNI will therefore be binding once the relevant binding resolutions of the CCNR make a reference to those technical standards.
(3) Under the Convention, the CCNR may modify its regulatory framework related to river information services (‘RIS’) by referring to the technical standards adopted by the CESNI and making those technical standards mandatory in the framework of the application of the Convention.
(4) The CESNI is to adopt an updated European Standard laying down Technical requirements for Inland Navigation vessels 2025/1 (‘ES-TRIN 2025/1’) and the European Standard for River Information Services 2025/1 (‘ES-RIS 2025/1’) during its session on 17 October 2024. Following the adoption of those standards, the CCNR intends to adopt a resolution amending the Rhine Regulations to refer to ES-TRIN 2025/1 and ES-RIS 2025/1 during its plenary session on 5 December 2024. ES-TRIN 2025/1 and ES-RIS 2025/1 replace ES-TRIN 2023/1 and ES-RIS 2023/1 accordingly.
(5) ES-TRIN 2025/1 lays down uniform technical requirements necessary to ensure the safety of inland waterway vessels. It includes provisions regarding shipbuilding, fitting out and equipment for inland waterway vessels, special provisions regarding specific categories of vessels such as passenger vessels, pushed convoys and container vessels, provisions regarding automatic identification system equipment, provisions regarding vessel identification, a model of certificates and register, transitional provisions, as well as instructions for the application of the technical standard.
(6) It is appropriate to establish the position to be taken on the Union’s behalf within the CESNI and within the CCNR, as ES-TRIN 2025/1 will be capable of decisively influencing the content of Union law. Articles 31 and 32 of Directive (EU) 2016/1629 require the Commission to adopt delegated acts which refer to the latest version of the ES-TRIN standard and to set the date of its application, provided that Union interests are not compromised by changes in the decision-making process of CESNI.
(7) ES-RIS 2025/1 lays down uniform technical specifications and standards in order to support RIS and ensure their interoperability. The technical specifications and standards laid down in ES-RIS 2025/1 correspond to the technical specifications and standards for which adoption is required by Directive 2005/44/EC of the European Parliament and of the Council(2), in particular in the following areas: electronic chart display and information system for inland navigation, electronic ship reporting, notices to skippers, vessel tracking and tracing systems and compatibility of the equipment necessary for the use of RIS.
(8) Technical specifications for RIS are based on the technical principles set out in Annex II to Directive 2005/44/EC, and take account of work carried out in this field by relevant international organisations.
(9) It is therefore appropriate to establish the position to be taken on the Union’s behalf within the CESNI, as ES-RIS 2025/1 will be capable of decisively influencing the content of Union law, namely the binding technical specifications adopted within the framework of Directive 2005/44/EC.
(10) The CCNR, during its upcoming plenary session, is expected to adopt resolutions that will amend its Rhine Regulations to include references to ES-TRIN 2025/1 and ES-RIS 2025/1. Such amendment will be binding under international law in accordance with Articles 1 and 22 of the Convention. Therefore, it is also appropriate to establish the position to be taken on the Union’s behalf within the CCNR.
(11) To facilitate the highest level of safety in inland navigation, to follow the technical evolution in that sector, and to ensure compatibility of requirements for vessels and compatibility of river information services in Europe it is important that the technical requirements for vessels and river information services be as harmonised as possible under the various legal regimes in Europe. In particular, Member States that are also members of the CCNR should be authorised to support decisions harmonising the CCNR rules with the rules applied in the Union.
(12) The Union is neither a member of the CCNR nor of the CESNI. The Union’s position should therefore be expressed by the Member States that are members of those bodies, acting jointly in the interests of the Union,
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 91(1), in conjunction with Article 218(9) thereof,
Having regard to the proposal from the European Commission,
Whereas:

Decision (EU) 2024/2683 of the European Central Bank of 8 October 2024 amending Decision ECB/2013/1 laying down the framework for a public key infrastructure for the European System of Central Banks (ECB/2024/26)

Official Journalof the European Union ENL series
2024/2683 15.10.2024
(1) Decision ECB/2013/1 of the European Central Bank(1)established the framework for the Eurosystem public key infrastructure (hereinafter the ‘ESCB-PKI’) to regulate the issuance and management of electronic certificates that are required to access and use ESCB and Eurosystem electronic applications, systems, platforms and services with medium or above medium criticality.
(2) The technology used by the ESCB-PKI has reached the end of its life and has been replaced. It is therefore necessary to introduce a new online ESCB-PKI certification authority (hereinafter the ‘online ESCB-PKI certification authority V1.2’), which should also take into account that the three-year validity of the certificates issued for ESCB and non-ESCB users and technical components under an online ESCB-PKI certification authority cannot expire later than the expiration of the certificate of that online ESCB-PKI certification authority itself. The certificate of the existing online ESCB-PKI certification authority expires on 22 July 2026, and thereafter the online ESCB-PKI certification authority V1.2 would be the sole online ESCB-PKI certification authority, until the expiry of its certificate.
(3) Therefore, Decision ECB/2013/1 should be amended accordingly,
(i) issuing private and public key certificates;
(ii) issuing revocation lists;
(iii) generating key pairs associated with specific certificates, e.g. those that require key recovery;
(iv) maintaining overall responsibility for the ESCB-PKI and ensuring that all the requirements necessary to operate it are met.

Commission Implementing Decision (EU) 2024/2681 of 8 October 2024 amending the Annex to Implementing Decision (EU) 2023/2447 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States (notified under document C(2024) 7111)

Official Journalof the European Union ENL series
2024/2681 11.10.2024
(1) Highly pathogenic avian influenza (HPAI) is an infectious viral disease in birds and can have a severe impact on the profitability of poultry farming causing disturbance to trade within the Union and exports to third countries. HPAI viruses can infect migratory birds, which can then spread these viruses over long distances during their autumn and spring migrations. Therefore, the presence of HPAI viruses in wild birds poses a continuous threat for the direct and indirect introduction of these viruses into holdings where poultry or captive birds are kept. In the event of an outbreak of HPAI, there is a risk that the disease agent may spread to other holdings where poultry or captive birds are kept.
(2) Regulation (EU) 2016/429 establishes the legislative framework for the prevention and control of diseases that are transmissible to animals or humans. HPAI falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687(2)supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI.
(3) Commission Implementing Decision (EU) 2023/2447(3)was adopted within the framework of Regulation (EU) 2016/429 and it lays down emergency measures at Union level in relation to outbreaks of HPAI.
(4) More particularly, Implementing Decision (EU) 2023/2447 provides that the protection, surveillance and further restricted zones, established by the Member States concerned following outbreaks of HPAI, in accordance with Delegated Regulation (EU) 2020/687, are to comprise at least the areas listed as protection, surveillance and further restricted zones in the Annex to that Implementing Decision.
(5) The Annex to Implementing Decision (EU) 2023/2447 was recently amended by Commission Implementing Decision (EU) 2024/2529(4)following outbreaks of HPAI in poultry in Czechia, Denmark and Germany, which needed to be reflected in that Annex.
(6) Since the date of adoption of Implementing Decision (EU) 2024/2529, Bulgaria, Czechia, Germany, France, Italy and Hungary have notified the Commission of outbreaks of HPAI, in establishments where poultry were kept located in Plovdiv province in Bulgaria, in Plzeňský region in Czechia, in Saxony state in Germany, in Finistère department in France, in Veneto region in Italy, and in Békés and Jász–Nagykun–Szolnok counties in Hungary.
(7) Bulgaria, Czechia, Germany, France, Italy and Hungary have taken the necessary disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around the outbreaks.
(8) The Commission has examined the disease control measures taken by Bulgaria, Czechia, Germany, France, Italy and Hungary, and it is satisfied that the boundaries of the protection and surveillances zones established by those Member States are at a sufficient distance from the establishments where the outbreaks of HPAI have been confirmed.
(9) In the Annex to Implementing Decision (EU) 2023/2447, there are currently no areas listed as protection and surveillance zones for Bulgaria, Italy and Hungary.
(10) In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with Bulgaria, Czechia, Germany, France, Italy and Hungary the protection and surveillance zones duly established by those Member States in accordance with Delegated Regulation (EU) 2020/687.
(11) Therefore, the areas listed as protection and surveillance zones for Czechia, Germany and France in the Annex to Implementing Decision (EU) 2023/2447 should be amended.
(12) In addition, protection and surveillance zones should be listed for Bulgaria, Italy and Hungary in the Annex to Implementing Decision (EU) 2023/2447.
(13) Accordingly, the Annex to Implementing Decision (EU) 2023/2447 should be amended to update regionalisation at Union level to take account of the protection and surveillance zones duly established by Bulgaria, Czechia, Germany, France, Italy and Hungary in accordance with Delegated Regulation (EU) 2020/687, and the duration of the measures applicable therein.
(14) Implementing Decision (EU) 2023/2447 should therefore be amended accordingly.
(15) Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI, it is important that the amendments to be made to Implementing Decision (EU) 2023/2447 by this Decision take effect as soon as possible.
(16) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

* In accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community, and in particular Article 5(4) of the Windsor Framework (see Joint Declaration No 1/2023 of the Union and the United Kingdom in the Joint Committee established by the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community of 24 March 2023,OJ L 102, 17.4.2023, p. 87) in conjunction with Annex 2 to that Framework, for the purposes of this Annex, references to Member State include the United Kingdom in respect of Northern Ireland.
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (c), thereof,
Whereas:
In addition, Commission Delegated Regulation (EU) 2020/687 (2) supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI.
(3) Commission Implementing Decision (EU) 2023/2447 (3) was adopted within the framework of Regulation (EU) 2016/429 and it lays down emergency measures at Union level in relation to outbreaks of HPAI.
(5) The Annex to Implementing Decision (EU) 2023/2447 was recently amended by Commission Implementing Decision (EU) 2024/2529 (4) following outbreaks of HPAI in poultry in Czechia, Denmark and Germany, which needed to be reflected in that Annex.
(16) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
HAS ADOPTED THIS DECISION:
The Annex to Implementing Decision (EU) 2023/2447 is replaced by the text set out in the Annex to this Decision.
This Decision is addressed to the Member States.

Council Implementing Decision (EU) 2024/2680 of 8 October 2024 amending Implementing Decision (EU) 2021/1778 authorising Germany to continue to apply a special measure derogating from Article 193 of Directive 2006/112/EC on the common system of value added tax

Official Journalof the European Union ENL series
2024/2680 11.10.2024
(1) Pursuant to Article 193 of Directive 2006/112/EC, a taxable person carrying out a taxable supply of goods or services is, as a general rule, liable for the payment of value added tax (VAT) to the tax authorities.
(2) Council Implementing Decision (EU) 2021/1778(2)authorised Germany to apply, until 31 December 2024, a special measure derogating from Article 193 of Directive 2006/112/EC to designate the taxable person receiving transfers of emission allowances under the Fuels Emissions Trading Act (BEHG) as liable for the payment of VAT (the ‘special measure’).
(3) By letter registered with the Commission on 19 February 2024, Germany requested the extension of the special measure and thereby an authorisation to continue to apply the special measure beyond 31 December 2024 (‘the request’).
(4) In accordance with Article 395(2), second subparagraph, of Directive 2006/112/EC, the Commission transmitted the request to the other Member States by letter dated 27 March 2024. By letter dated 2 April 2024, the Commission notified Germany that it had all the information necessary to consider the request.
(5) According to the information provided by Germany, the factual situation which justified the application of the special measure has not changed. Germany submitted to the Commission, together with the request, a report on the overall positive experience in applying the special measure that shows that the use of the reverse charge mechanism in the transfer of emission allowances under the BEHG has proven its worth in practice. The special measure is an important component of the fight against VAT fraud, the importance of which is expected to grow even further in the coming years due to changing market conditions.
(6) It is therefore appropriate to extend the special measure. The extension of the special measure should be limited in time to allow the Commission to evaluate its effectiveness and appropriateness. The special measure should therefore expire on 31 December 2026.
(7) If Germany wishes to extend the special measure beyond 2026, it should submit a report to the Commission, including a review of the special measure together with the extension request by 31 March 2026 at the latest. That report should include an assessment of the impact of the special measure on the fight against VAT fraud and the number of traders and transactions affected by that measure.
(8) The special measure will have no adverse impact on the Union’s own resources accruing from VAT.
(9) Implementing Decision (EU) 2021/1778 should therefore be amended accordingly,
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax (1), and in particular Article 395(1), first subparagraph, thereof,
Having regard to the proposal from the European Commission,
Whereas:
(1) Pursuant to Article 193 of Directive 2006/112/EC, a taxable person carrying out a taxable supply of goods or services is, as a general rule, liable for the payment of value added tax (VAT) to the tax authorities.
(2) Council Implementing Decision (EU) 2021/1778 (2) authorised Germany to apply, until 31 December 2024, a special measure derogating from Article 193 of Directive 2006/112/EC to designate the taxable person receiving transfers of emission allowances under the Fuels Emissions Trading Act (BEHG) as liable for the payment of VAT (the ‘special measure’).
(9) Implementing Decision (EU) 2021/1778 should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 2 of Implementing Decision (EU) 2021/1778 is replaced by the following:

‘Article 2
This Decision shall expire on 31 December 2026. Any request for an extension of the special measure provided for in this Decision shall be submitted to the Commission by 31 March 2026 and shall be accompanied by a report which includes an assessment of the special measure and of its impact on the fight against VAT fraud and the number of traders and transactions affected by that measure.’.

Commission Decision (EU) 2024/2674 of 26 July 2024 on State aid SA.39235 (2015/C) – Hungary – Taxation of advertisement turnover (notified under document C(2024) 5283)

Official Journalof the European Union ENL series
2024/2674 14.10.2024
(1) In July 2014, the Commission became aware that Hungary had adopted Act XXII of 2014 on advertisement tax(1)(hereinafter: ‘the Act on advertisement tax’) on the basis of which turnover from advertising activities was taxed (hereinafter: ‘the advertisement tax’). By letters of 13 August and 1 December 2014, the Commission sent information requests to the Hungarian authorities, to which they replied by letters of 2 October and 16 December 2014.
(2) By letter of 2 February 2015, the Commission informed the Hungarian authorities that it envisaged issuing a suspension injunction decision in accordance with Article 11(1) of Council Regulation (EC) No 659/1999(2). By letter of 17 February 2015, the Hungarian authorities submitted their comments on that letter.
(3) By decision of 12 March 2015, the Commission initiated the procedure laid down in Article 108(2) TFEU (hereinafter: ‘the Opening Decision’) and issued a suspension injunction in accordance with Article 11(1) of Regulation (EC) No 659/1999 in respect of the measure at issue.
(4) The Opening Decision and the suspension injunction were published in theOfficial Journal of the European Union(3). The Commission invited interested parties to submit their comments on that measure.
(5) The Commission received comments from three interested parties and forwarded them to the Hungarian authorities who were given the opportunity to react.
(6) On 21 April 2015, the Hungarian authorities sent a draft proposal to the Commission for an amendment to the Act on advertisement tax. On 8 May 2015, the Commission requested information from Hungary on that planned amendment.
(7) On 4 June 2015, Hungary amended the Act on advertisement tax. On 5 July 2015, that amendment entered into force.
(8) By letter of 6 July 2015, Hungary provided observations on the Opening Decision and on the interested parties’ comments, as well as clarifications on the amendment to the Act on the advertisement tax.
(9) On 4 November 2016, by its decision on the measure implemented by Hungary on the taxation of advertisement turnover(4)(the ‘Final Decision’), the Commission closed the formal investigation procedure by concluding that the measure amounted to unlawful and incompatible State aid and ordered the recovery of the aid.
(10) On 16 December 2016, the Hungarian authorities informed the Commission services that, in accordance with recital 96 of the Final Decision, they intended to adopt an Act abolishing the advertisement tax and replace it with a new one for the future.
(11) By application lodged at the Registry of the General Court on 16 January 2017, Hungary brought an action for annulment against the Final Decision (Case T-20/17).
(12) On 16 December 2016, 26 January and 17 February 2017, the Commission services and Hungary exchanged correspondence, leading to a conference call that took place on 27 February 2017 to discuss the abolition of the advertisement tax.
(13) On 15 May 2017, Hungary retroactively abolished the advertisement tax for the period up to 30 June 2017, and replaced it with a new advertisement tax (see recital (23) below). That amendment to the Act on advertisement tax entered into force on 1 July 2017(5).
(14) By judgment of 27 June 2019 in case T-20/17 Hungary v Commission(6), the General Court annulled the Final Decision, having concluded that the Commission had failed to prove the existence of State aid within the meaning of Article 107(1) TFEU.
(15) On 23 July 2019, Hungary further amended the Act on advertisement tax by suspending the tax until December 2022(7).
(16) On 6 August 2019, the Commission lodged an appeal against the judgment of the General Court. By judgment of 16 March 2021 in case C-596/19 P(8), the Court of Justice dismissed the Commission’s appeal and upheld the judgment of the General Court.
(17) Following the annulment of the Final Decision by the General Court as confirmed by the Court of Justice, the formal investigation procedure is still open, and must be closed by decision.
(18) The measure assessed in the Opening Decision is the advertisement tax introduced in Hungary by the Act on advertisement tax which entered into force on 18 July 2014, with further amendments on 4 July and 18 November 2014 (hereinafter: ‘the Act’).
(19) The tax featured a steep progressive structure, with rates ranging from 0 % for companies with low advertising turnover to 50 % for companies with high advertising turnover, as follows (‘the 2014 version’):—for the part of the turnover below HUF 0,5 billion: 0 %;—for the part of the turnover between HUF 0,5 billion and 5 billion: 1 %;—for the part of the turnover between HUF 5 billion and 10 billion: 10 %;—for the part of the turnover between HUF 10 billion and 15 billion: 20 %;—for the part of the turnover between HUF 15 billion and 20 billion: 30 %;—for the part of the turnover above HUF 20 billion: 50 %(9). — for the part of the turnover below HUF 0,5 billion: 0 %; — for the part of the turnover between HUF 0,5 billion and 5 billion: 1 %; — for the part of the turnover between HUF 5 billion and 10 billion: 10 %; — for the part of the turnover between HUF 10 billion and 15 billion: 20 %; — for the part of the turnover between HUF 15 billion and 20 billion: 30 %; — for the part of the turnover above HUF 20 billion: 50 %(9).
— for the part of the turnover below HUF 0,5 billion: 0 %;
— for the part of the turnover between HUF 0,5 billion and 5 billion: 1 %;
— for the part of the turnover between HUF 5 billion and 10 billion: 10 %;
— for the part of the turnover between HUF 10 billion and 15 billion: 20 %;
— for the part of the turnover between HUF 15 billion and 20 billion: 30 %;
— for the part of the turnover above HUF 20 billion: 50 %(9).
— for the part of the turnover below HUF 0,5 billion: 0 %;
— for the part of the turnover between HUF 0,5 billion and 5 billion: 1 %;
— for the part of the turnover between HUF 5 billion and 10 billion: 10 %;
— for the part of the turnover between HUF 10 billion and 15 billion: 20 %;
— for the part of the turnover between HUF 15 billion and 20 billion: 30 %;
— for the part of the turnover above HUF 20 billion: 50 %(9).
(20) After the adoption of the Opening Decision, Hungary amended the Act on advertisement tax by Act LXII of 2015 of 4 June 2015, replacing the progressive scale of six tax rates by a dual rate system as follows (hereinafter: ‘2015 version’):—for the part of the turnover below HUF 100 million: 0 %;—for the part of the turnover above HUF 100 million: 5,3 %(10). — for the part of the turnover below HUF 100 million: 0 %; — for the part of the turnover above HUF 100 million: 5,3 %(10).
— for the part of the turnover below HUF 100 million: 0 %;
— for the part of the turnover above HUF 100 million: 5,3 %(10).
— for the part of the turnover below HUF 100 million: 0 %;
— for the part of the turnover above HUF 100 million: 5,3 %(10).
(21) In November 2016 the Commission closed the formal investigation procedure by adopting the negative Final Decision.
(22) The Final Decision assessed both the 2014 and the 2015 versions of the advertisement tax. The Commission considered that the 2015 version was based on the same principle of progressivity and had the same effect of favouring smaller undertakings over larger ones as the 2014 version of the tax.
(23) After the adoption of the Final Decision, in 2017, Hungary modified the advertisement tax by a further amendment to the Act on advertisement tax(11). The amending law:—replaced the advertisement tax declared incompatible by the Final Decision (that is to say the tax in its 2014 and 2015 versions) with a new version of the advertisement tax(12);—provided that tax declared and paid between 18 July 2014 and 30 June 2017 under the abolished advertisement tax were to be considered an overpayment of taxes under the Hungarian Tax Code and was subject to the tax refund rules of the Tax Code(13). — replaced the advertisement tax declared incompatible by the Final Decision (that is to say the tax in its 2014 and 2015 versions) with a new version of the advertisement tax(12); — provided that tax declared and paid between 18 July 2014 and 30 June 2017 under the abolished advertisement tax were to be considered an overpayment of taxes under the Hungarian Tax Code and was subject to the tax refund rules of the Tax Code(13).
— replaced the advertisement tax declared incompatible by the Final Decision (that is to say the tax in its 2014 and 2015 versions) with a new version of the advertisement tax(12);
— provided that tax declared and paid between 18 July 2014 and 30 June 2017 under the abolished advertisement tax were to be considered an overpayment of taxes under the Hungarian Tax Code and was subject to the tax refund rules of the Tax Code(13).
— replaced the advertisement tax declared incompatible by the Final Decision (that is to say the tax in its 2014 and 2015 versions) with a new version of the advertisement tax(12);
— provided that tax declared and paid between 18 July 2014 and 30 June 2017 under the abolished advertisement tax were to be considered an overpayment of taxes under the Hungarian Tax Code and was subject to the tax refund rules of the Tax Code(13).
(24) As regards the tax in force and already paid since the entry into force of the Act on advertisement tax, Act XLVII of 2017 provided that, for tax years up to 30 June 2017:—‘the tax declared and paid (…) shall be deemed to be overpayment within the meaning of the Tax Code, the reimbursement of which shall be subject to the tax refund rules of the Tax Code. The state tax authority shall notify the taxable persons, referred to in Section 3(1) who are entitled to a tax refund under this Section, of the possibility and the conditions for reimbursement of the advertisement tax’;—‘tax declared but not paid for tax years completed by 30 June 2017 shall not be paid’. — ‘the tax declared and paid (…) shall be deemed to be overpayment within the meaning of the Tax Code, the reimbursement of which shall be subject to the tax refund rules of the Tax Code. The state tax authority shall notify the taxable persons, referred to in Section 3(1) who are entitled to a tax refund under this Section, of the possibility and the conditions for reimbursement of the advertisement tax’; — ‘tax declared but not paid for tax years completed by 30 June 2017 shall not be paid’.
— ‘the tax declared and paid (…) shall be deemed to be overpayment within the meaning of the Tax Code, the reimbursement of which shall be subject to the tax refund rules of the Tax Code. The state tax authority shall notify the taxable persons, referred to in Section 3(1) who are entitled to a tax refund under this Section, of the possibility and the conditions for reimbursement of the advertisement tax’;
— ‘tax declared but not paid for tax years completed by 30 June 2017 shall not be paid’.
— ‘the tax declared and paid (…) shall be deemed to be overpayment within the meaning of the Tax Code, the reimbursement of which shall be subject to the tax refund rules of the Tax Code. The state tax authority shall notify the taxable persons, referred to in Section 3(1) who are entitled to a tax refund under this Section, of the possibility and the conditions for reimbursement of the advertisement tax’;
— ‘tax declared but not paid for tax years completed by 30 June 2017 shall not be paid’.
(25) The provisions of the Hungarian Tax Code in force when Act XLVII of 2017 entered into force(14)define ‘overpayment’ as the situation in which the taxpayer ‘has at their disposal an amount in the tax account which exceeds their obligation to pay the tax’.
(26) Therefore, when the advertisement tax had been paid by the taxpayer, the effect of the provisions referred to in recitals 24 and 25 was that a tax credit arose in the taxpayer’s account.
(27) The Tax Code sets out different possibilities for the taxpayers to use the tax credit resulting from an overpayment.
(28) First, the taxpayer can request that the overpayment is used to cover tax liabilities of a different tax category(15). Second, the taxpayer can request a refund of the overpayment, provided that they do not have a tax debt and have complied with their tax return obligations(16). Third, the overpayment may remain with the tax authorities to cover future tax liabilities of the same tax category(17).
(29) The adoption of Act XLVII of 2017 therefore ensured the cancellation of the entirety of the advertisement tax debt due over the period from 2014 until 30 June 2017, and that the advertisement tax paid over that period was reimbursed to the taxpayers or used to cover other tax liabilities of those taxpayers.
(30) Last, the Commission observes that, in its judgment in case C-596/19 P, the Court of Justice acknowledged(18)that Act XLVII of 2017 had retroactively repealed the tax measure at issue(19).
(31) In light of the above, the Commission concludes that, due to the retroactive abolition of the advertisement tax subject to the formal investigation procedure by Hungary and, accordingly, the cancellation of the relevant tax debt and the reimbursement of the tax paid, the formal investigation procedure has become without object.
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 108(2), first subparagraph thereof,
Whereas:
1. Procedure
(1) In July 2014, the Commission became aware that Hungary had adopted Act XXII of 2014 on advertisement tax (1) (hereinafter: ‘the Act on advertisement tax’) on the basis of which turnover from advertising activities was taxed (hereinafter: ‘the advertisement tax’). By letters of 13 August and 1 December 2014, the Commission sent information requests to the Hungarian authorities, to which they replied by letters of 2 October and 16 December 2014.
(2) By letter of 2 February 2015, the Commission informed the Hungarian authorities that it envisaged issuing a suspension injunction decision in accordance with Article 11(1) of Council Regulation (EC) No 659/1999 (2).
(4) The Opening Decision and the suspension injunction were published in the Official Journal of the European Union (3).
(9) On 4 November 2016, by its decision on the measure implemented by Hungary on the taxation of advertisement turnover (4) (the ‘Final Decision’), the Commission closed the formal investigation procedure by concluding that the measure amounted to unlawful and incompatible State aid and ordered the recovery of the aid.
That amendment to the Act on advertisement tax entered into force on 1 July 2017 (5).
(14) By judgment of 27 June 2019 in case T-20/17 Hungary v Commission (6), the General Court annulled the Final Decision, having concluded that the Commission had failed to prove the existence of State aid within the meaning of Article 107(1) TFEU.
(15) On 23 July 2019, Hungary further amended the Act on advertisement tax by suspending the tax until December 2022 (7).
(16) On 6 August 2019, the Commission lodged an appeal against the judgment of the General Court. By judgment of 16 March 2021 in case C-596/19 P (8), the Court of Justice dismissed the Commission’s appeal and upheld the judgment of the General Court.
(17) Following the annulment of the Final Decision by the General Court as confirmed by the Court of Justice, the formal investigation procedure is still open, and must be closed by decision.
2. Background and Description of the measure
(18) The measure assessed in the Opening Decision is the advertisement tax introduced in Hungary by the Act on advertisement tax which entered into force on 18 July 2014, with further amendments on 4 July and 18 November 2014 (hereinafter: ‘the Act’).
(19) The tax featured a steep progressive structure, with rates ranging from 0 % for companies with low advertising turnover to 50 % for companies with high advertising turnover, as follows (‘the 2014 version’):
—
for the part of the turnover below HUF 0,5 billion: 0 %;
—
for the part of the turnover between HUF 0,5 billion and 5 billion: 1 %;
—
for the part of the turnover between HUF 5 billion and 10 billion: 10 %;
—
for the part of the turnover between HUF 10 billion and 15 billion: 20 %;
—
for the part of the turnover between HUF 15 billion and 20 billion: 30 %;
—
for the part of the turnover above HUF 20 billion: 50 % (9).
(20) After the adoption of the Opening Decision, Hungary amended the Act on advertisement tax by Act LXII of 2015 of 4 June 2015, replacing the progressive scale of six tax rates by a dual rate system as follows (hereinafter: ‘2015 version’):
—
for the part of the turnover below HUF 100 million: 0 %;
—
for the part of the turnover above HUF 100 million: 5,3 % (10).
(23) After the adoption of the Final Decision, in 2017, Hungary modified the advertisement tax by a further amendment to the Act on advertisement tax (11). The amending law:
—
replaced the advertisement tax declared incompatible by the Final Decision (that is to say the tax in its 2014 and 2015 versions) with a new version of the advertisement tax (12);
—
provided that tax declared and paid between 18 July 2014 and 30 June 2017 under the abolished advertisement tax were to be considered an overpayment of taxes under the Hungarian Tax Code and was subject to the tax refund rules of the Tax Code (13).
3. Repeal of the measure
(24) As regards the tax in force and already paid since the entry into force of the Act on advertisement tax, Act XLVII of 2017 provided that, for tax years up to 30 June 2017:
—
‘the tax declared and paid (…) shall be deemed to be overpayment within the meaning of the Tax Code, the reimbursement of which shall be subject to the tax refund rules of the Tax Code. The state tax authority shall notify the taxable persons, referred to in Section 3(1) who are entitled to a tax refund under this Section, of the possibility and the conditions for reimbursement of the advertisement tax’;
—
‘tax declared but not paid for tax years completed by 30 June 2017 shall not be paid’.
(25) The provisions of the Hungarian Tax Code in force when Act XLVII of 2017 entered into force (14) define ‘overpayment’ as the situation in which the taxpayer ‘has at their disposal an amount in the tax account which exceeds their obligation to pay the tax’.
(28) First, the taxpayer can request that the overpayment is used to cover tax liabilities of a different tax category (15). Second, the taxpayer can request a refund of the overpayment, provided that they do not have a tax debt and have complied with their tax return obligations (16). Third, the overpayment may remain with the tax authorities to cover future tax liabilities of the same tax category (17).
(30) Last, the Commission observes that, in its judgment in case C-596/19 P, the Court of Justice acknowledged (18) that Act XLVII of 2017 had retroactively repealed the tax measure at issue (19).
4. Conclusion
The procedure laid down in Article 108(2) TFEU has become without object due to the repeal of the measure by Hungary with retroactive effect and should therefore be closed.
HAS ADOPTED THIS DECISION:
The procedure initiated on 12 March 2015 pursuant to Article 108(2) TFEU in case SA.39235 has become without object and is hereby closed.
This Decision is addressed to Hungary.

Council Decision (EU) 2024/2669 of 26 September 2024 on the submission, on behalf of the European Union, of a proposal for the amendment of Appendices II and III to the Convention on the conservation of European wildlife and natural habitats and on the position to be adopted, on behalf of the Union, at the 44th meeting of the Standing Committee to that Convention

Official Journalof the European Union ENL series
2024/2669 10.10.2024
(1) The Convention on the conservation of European wildlife and natural habitats(1)(the ‘Bern Convention’) was concluded by the Union by means of Council Decision 82/72/EEC(2)and entered into force on 1 September 1982.
(2) Pursuant to Article 17 of the Bern Convention, the Standing Committee to the Bern Convention (the ‘Standing Committee’) is able to adopt amendments to the Appendices to that Convention.
(3) Pursuant to Article 17 of the Bern Convention, proposals for amendment are to be submitted at least two months prior to the meeting of the Standing Committee. The Union, as a Contracting Party to the Bern Convention, is able to propose amendments to the Appendices to that Convention.
(4) In view of Recommendation No 56 (1997) of the Standing Committee concerning guidelines to be taken into account while making proposals for amendment of Appendices I and II of the Convention and while adopting amendments, relevant considerations for listing species in the Appendices to the Bern Convention include ecological and scientific factors, such as conservation status, population trends and threats.
(5) Article 2 of the Bern Convention sets out the objective of achieving a population level of wild flora and fauna which corresponds in particular to ecological, scientific and cultural requirements, while taking account of economic and recreational requirements, and sets the broader context for measures taken by the Contracting Parties. That objective can be taken into account when proposing an amendment to the Appendices to the Bern Convention.
(6) The conservation status of the wolf (Canis lupus) has shown a positive trend over the last few decades. The species has successfully recovered across the European continent, with a significant expansion of its range. Its population has reached significant levels, with estimated population levels for the Union having nearly doubled in 10 years, from 11 193 in 2012 to 20 300 in 2023. Reports indicate that population levels are continuing to increase across the continent. In spite of remaining threats to the wolf species, the successful recovery of its population and its increased range across the continent in recent decades are evidence of the strong adaptability and resilience of the species.
(7) At the same time, the continued expansion of the wolf’s range in Europe and its recolonisation of new territories have led to increasing socioeconomic challenges with regard to coexistence with human activities. This is due, in particular, to harm to livestock, which has reached significant levels, affecting more and more regions and Member States, and beyond.
(8) The most recent data on the population size from the 2022 assessment of the status of the wolf developed by the Large Carnivore Initiative for Europe for the Bern Convention and from the in-depth analysis of the status of the wolf in the Union from 2023 provide adequate evidence in support of adapting the protection status of the wolf under the Bern Convention.
(9) Therefore, it is appropriate to adapt the protection level of the wolf species. The wolf species, which is currently listed in Appendix II to the Bern Convention, should be subject to the species protection resulting from a listing in Appendix III to the Bern Convention, in connection with Article 7 of that Convention.
(10) The adaptation of the protection level of the wolf species would add flexibility to address the increasing socioeconomic challenges relating to the wolf linked to the continued expansion of the wolf’s range in Europe and its recolonisation of new territories.
(11) As provided for in Recommendation No 163 (2012) of the Standing Committee to the Bern Convention, adopted on 30 November 2012, on the management of expanding populations of large carnivores in Europe, Contracting Parties to the Bern Convention are encouraged to collaborate as appropriate with other states sharing the same populations, with the objective of keeping them healthy and maintaining a favourable conservation status. Such cooperation, involving coexistence and protection measures, remains necessary and relevant if the wolf species is listed in Appendix III to the Bern Convention.
(12) Therefore, with a view to preparing for the 44th meeting of the Standing Committee, which is due to take place in 2024, the Union should submit a proposal to amend Appendices II and III to the Bern Convention by removing the wolf (Canis lupus) species from Appendix II and listing it under Appendix III. The Commission should communicate that proposal to the Secretariat of the Bern Convention.
(13) It is also appropriate to establish the position to be adopted on the Union’s behalf at the 44th meeting of the Standing Committee, as any decisions amending the Appendices to the Bern Convention will be binding on the Union.
(14) The Union should support the proposed amendment to remove the wolf (Canis lupus) species from Appendix II to the Bern Convention and list it under Appendix III to that Convention,
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 192(1), in conjunction with Article 218(9), thereof,
Having regard to the proposal from the European Commission,
Whereas:
(1) The Convention on the conservation of European wildlife and natural habitats (1) (the ‘Bern Convention’) was concluded by the Union by means of Council Decision 82/72/EEC (2) and entered into force on 1 September 1982.
(14) The Union should support the proposed amendment to remove the wolf (Canis lupus) species from Appendix II to the Bern Convention and list it under Appendix III to that Convention,
HAS ADOPTED THIS DECISION:
1. With a view to the 44th meeting of the Standing Committee to the Bern Convention (the ‘Standing Committee’), the Union shall submit a proposal to remove the wolf (Canis lupus) species from Appendix II (‘Strictly protected fauna species’) to the Bern Convention and add it to Appendix III (‘Protected fauna species’) to that Convention.

2. The Commission, on behalf of the Union, shall communicate the proposal referred to in paragraph 1 to the Secretariat of the Bern Convention.

The position to be adopted on the Union’s behalf at the 44th meeting of the Standing Committee shall be to support removing the wolf (Canis lupus) species from Appendix II to the Bern Convention and adding it to Appendix III to that Convention.
Refinement of the position referred to in Article 2 may be agreed to, in the light of developments at the 44th meeting of the Standing Committee, by the representatives of the Union, in consultation with Member States during on-the-spot coordination meetings, without a further decision of the Council.
This Decision shall enter into force on the date of its adoption.
