Commission Implementing Decision (EU) 2024/2743 of 21 October 2024 amending the Annex to Implementing Decision (EU) 2023/2447 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States (notified under document C(2024) 7450)

Official Journalof the European Union ENL series
2024/2743 22.10.2024
(1) Highly pathogenic avian influenza (HPAI) is an infectious viral disease in birds and can have a severe impact on the profitability of poultry farming causing disturbance to trade within the Union and exports to third countries. HPAI viruses can infect migratory birds, which can then spread these viruses over long distances during their autumn and spring migrations. Therefore, the presence of HPAI viruses in wild birds poses a continuous threat for the direct and indirect introduction of these viruses into holdings where poultry or captive birds are kept. In the event of an outbreak of HPAI, there is a risk that the disease agent may spread to other holdings where poultry or captive birds are kept.
(2) Regulation (EU) 2016/429 establishes the legislative framework for the prevention and control of diseases that are transmissible to animals or humans. HPAI falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687(2)supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI.
(3) Commission Implementing Decision (EU) 2023/2447(3)was adopted within the framework of Regulation (EU) 2016/429 and it lays down emergency measures at Union level in relation to outbreaks of HPAI.
(4) More particularly, Implementing Decision (EU) 2023/2447 provides that the protection, surveillance and further restricted zones, established by the Member States concerned following outbreaks of HPAI, in accordance with Delegated Regulation (EU) 2020/687, are to comprise at least the areas listed as protection, surveillance and further restricted zones in the Annex to that Implementing Decision.
(5) The Annex to Implementing Decision (EU) 2023/2447 was recently amended by Commission Implementing Decision (EU) 2024/2681(4)following outbreaks of HPAI in poultry in Bulgaria, Czechia, Germany, France, Italy and Hungary, which needed to be reflected in that Annex.
(6) Since the date of adoption of Implementing Decision (EU) 2024/2681, Italy, Hungary. Austria and Poland have notified the Commission of outbreaks of HPAI, in establishments where poultry were kept located in Emilia-Romagna and Lombardy regions in Italy, in Békés and Csongrád-Csanád counties in Hungary, in Oberösterreich federal state in Austria and in Dolnośląskie voivodeship in Poland.
(7) Italy, Hungary, Austria and Poland have taken the necessary disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around the outbreaks.
(8) The Commission has examined the disease control measures taken by Italy, Hungary, Austria and Poland, and it is satisfied that the boundaries of the protection and surveillances zones established by those Member States are at a sufficient distance from the establishments where the outbreaks of HPAI have been confirmed.
(9) In the Annex to Implementing Decision (EU) 2023/2447, there are currently no areas listed as protection and surveillance zones for Austria and Poland.
(10) In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with Italy, Hungary, Austria and Poland the protection and surveillance zones duly established by those Member States in accordance with Delegated Regulation (EU) 2020/687.
(11) Therefore, the areas listed as protection and surveillance zones for Italy and Hungary in the Annex to Implementing Decision (EU) 2023/2447 should be amended.
(12) In addition, protection and surveillance zones should be listed for Austria and Poland in the Annex to Implementing Decision (EU) 2023/2447.
(13) Accordingly, the Annex to Implementing Decision (EU) 2023/2447 should be amended to update regionalisation at Union level to take account of the protection and surveillance zones duly established by Italy, Hungary, Austria and Poland in accordance with Delegated Regulation (EU) 2020/687, and the duration of the measures applicable therein.
(14) Implementing Decision (EU) 2023/2447 should therefore be amended accordingly.
(15) Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI, it is important that the amendments to be made to Implementing Decision (EU) 2023/2447 by this Decision take effect as soon as possible.
(16) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

* In accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community, and in particular Article 5(4) of the Windsor Framework (see Joint Declaration No 1/2023 of the Union and the United Kingdom in the Joint Committee established by the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community of 24 March 2023,OJ L 102, 17.4.2023, p.87) in conjunction with Annex 2 to that Framework, for the purposes of this Annex, references to Member State include the United Kingdom in respect of Northern Ireland.
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (c), thereof,
Whereas:
In addition, Commission Delegated Regulation (EU) 2020/687 (2) supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI.
(3) Commission Implementing Decision (EU) 2023/2447 (3) was adopted within the framework of Regulation (EU) 2016/429 and it lays down emergency measures at Union level in relation to outbreaks of HPAI.
(5) The Annex to Implementing Decision (EU) 2023/2447 was recently amended by Commission Implementing Decision (EU) 2024/2681 (4) following outbreaks of HPAI in poultry in Bulgaria, Czechia, Germany, France, Italy and Hungary, which needed to be reflected in that Annex.
(16) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
HAS ADOPTED THIS DECISION:
The Annex to Implementing Decision (EU) 2023/2447 is replaced by the text set out in the Annex to this Decision.
This Decision is addressed to the Member States.

Commission Implementing Decision (EU) 2024/2740 of 24 October 2024 granting a derogation allowing Ireland to use means other than electronic data-processing techniques for the exchange and storage of information for the release into free circulation of goods in postal consignments availing of relief under Articles 25 to 27 of Council Regulation (EC) No 1186/2009 sent by a private individual in the United Kingdom to a private individual in Ireland (notified under document C(2024) 7322)

Official Journalof the European Union ENL series
2024/2740 28.10.2024
(1) Article 6(1) of Regulation (EU) No 952/2013 requires that all exchanges of information between customs authorities and between economic operators and customs authorities, and the storage of such information, as required under the customs legislation, be made using electronic data-processing techniques.
(2) Article 6(4) of Regulation (EU) No 952/2013 provides for the possibility to adopt decisions in exceptional cases to allow one or several Member States to derogate from using electronic data processing techniques for the exchange and storage of information, if such derogation is justified by the specific situation of the requesting Member State and is granted for a specific period of time.
(3) Commission Implementing Decision (EU) 2023/2879(2)establishes the work programme relating to the development and deployment of the electronic systems provided for in the Union Customs Code (‘the work programme’). The work programme lists the electronic systems to be developed and the dates on which those systems are expected to become operational. It also specifies the implementation and dates of deployment for the National Import System (‘NIS’) and component 2 of the Special Procedures that together cover the customs procedures for goods brought into the customs territory of the Union in accordance with Articles 158, 162, 163, 166, 167, 170 to 174, 201, 240, 250, 254 and 256 of Regulation (EU) No 952/2013. It also specifies the implementation and dates of deployment of the various ‘steps’ of Release 3 of the Import Control System 2 (‘ICS2’) in accordance with Article 6(1), Articles 16, 46, 47 and 127 to 132, of Regulation (EU) No 952/2013.
(4) In accordance with Articles 143a and 144 of Commission Delegated Regulation (EU) 2015/2446(3), import declarations for release for free circulation of consignments of low value by postal operators are to be lodged in Member States’ National Import systems.
(5) Furthermore, Article 278(2), point (b), of Regulation (EU) No 952/2013 specifies the deadline until which means other than the electronic data-processing techniques may be used on a transitional basis to implement the provisions related to the customs declaration in relation to goods brought into the customs territory of the Union.
(6) Although Ireland has deployed the necessary electronic systems on time, in compliance with the deadlines specified in the work programme, the postal operator in Ireland is not yet in a position to comply fully with the requirements of Articles 143a and 144 of Delegated Regulation (EU) 2015/2446 and Article 278(2), point (b), of Regulation (EU) No 952/2013. This is due to an exceptional circumstance caused by the United Kingdom’s postal operator’s inability to provide sufficient data to the Irish postal operator to allow for the creation of an electronic import declaration, for certain goods in postal consignments, benefiting from relief from customs duty and taxes under Articles 25, 26 and 27 of Council Regulation (EC) No 1186/2009(4)and Articles 1 and 2 of Council Directive 2006/79/EC(5)(‘gift relief’). This concerns such goods where they are sent by private individuals in the United Kingdom to private individuals in Ireland.
(7) The specific historical and geographical relationship between Ireland and the United Kingdom and the high volumes of consignments benefitting from gift relief the Irish postal operator receives from private individuals in the United Kingdom on a daily basis, justifies the granting of a derogation in accordance with Regulation (EU) No 952/2013, requested by the customs authority of Ireland on 5 March 2024. Therefore, such derogation should temporarily allow Ireland to use means other than electronic data-processing techniques for the exchange and storage of information in relation to the release for free circulation of goods in postal consignments, benefiting from gift relief and sent by private individuals in the United Kingdom to private individuals in Ireland.
(8) In applying this Decision, the customs authority of Ireland should continue to request presentation of consignments to customs where the data provided by the United Kingdom postal operator is incomplete or not of sufficient quality to submit an electronic declaration and to carry out physical controls for risk-assessment purposes on those consignments.
(9) The duration of the derogation should be based on the deadline for the implementation of the obligations related to release 3 of ICS2, specified in the Annex to the work programme as 1 September 2025, and in accordance with Article 127 of Regulation (EU) No 952/2013 and Article 183 (1a), points (a) and (b), of Commission Implementing Regulation (EU) 2015/2447(6).
(10) From that date, the obligation to lodge an entry summary declaration will supersede the requirement to create an electronic import declaration. Postal operators, including the UK postal operator, are to lodge entry summary declarations using ICS2 which should provide the Irish postal operator with sufficient data to create an electronic import declaration. Where the data received after that date is not sufficient to create an electronic import declaration, Ireland would be expected to capture the data manually from the CN22/CN23 form provided, or to return the consignments.
(11) In accordance with the request submitted by Ireland, and in line with the emergence of the realities of the specific situation facing Ireland, upon which this Decision is based, this Decision should apply retroactively from 1 April 2024 and it should apply until 1 September 2025, at the latest,

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to the Internal Agreement between the Representatives of the Governments of the Member States of the European Union, meeting within the Council, on the financing of European Union aid under the multiannual financial framework for the period 2014 to 2020, in accordance with the ACP-EU Partnership Agreement and on the allocation of financial assistance for the Overseas Countries and Territories to which Part Four of the Treaty on the Functioning of the European Union applies (1), and in particular Article 7(2) in conjunction with Article 14(3) thereof,
Having regard to the Council Regulation (EU) 2018/1877 of 26 November 2018 on the financial regulation applicable to the 11th European Development Fund, and repealing Regulation (EU) 2015/323 (2), and in particular Article 19(5) thereof,
Having regard to the proposal from the European Commission,
Whereas:

(5) Council Decision (EU) 2023/2586 (3) sets the annual amount of the contribution to be paid by the parties to the EDF for 2024 at EUR 1 200 000 000 for the Commission, and at EUR 300 000 000 for the EIB.
(6) In order to allow for the prompt application of the measures provided for in this Decision, this Decision should enter into force on the day of its publication in the Official Journal of the European Union,

Council Decision (EU) 2024/2713 of 10 October 2024 on the position to be taken on behalf of the European Union within the Council of Members of the International Olive Council with respect to the accession of San Marino to the International Agreement on Olive Oil and Table Olives, 2015

Official Journalof the European Union ENL series
2024/2713 18.10.2024
(1) The International Agreement on Olive Oil and Table Olives, 2015 (the ‘Agreement’) was concluded on behalf of the Union by means of Council Decision (EU) 2019/848(1).
(2) Pursuant to Article 29 of the Agreement, the Council of Members of the International Olive Council (the ‘Council of Members’) is to establish the conditions for the accession of a Government to the Agreement.
(3) The Government of San Marino has formally applied to accede to the Agreement. The Council of Members will therefore be invited, during a future session thereof, or within the framework of a procedure for adoption of decisions by the Council of Members by exchange of correspondence, to establish the conditions for the accession of San Marino, in respect of the participation shares in the International Olive Council (IOC) and the time limit for the deposit of the instrument of accession.
(4) Given that San Marino is developing its olive sector as regards consumption and intends to develop its production, its accession could, under certain conditions, reinforce the IOC, in particular as regards the achievement of uniformity in national and international legislation relating to the characteristics of olive products in order to prevent any obstacle to trade.
(5) It is appropriate to establish the position to be taken on the Union’s behalf within the Council of Members, as the decisions to be adopted will have legal effects on the Union by impacting the decisional balance within the Council of Members when decisions are not adopted by consensus in accordance with Article 10(4) of the Agreement,
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 207 (4), first subparagraph, in conjunction with Article 218(9) thereof,
Having regard to the proposal from the European Commission,
Whereas:
(1) The International Agreement on Olive Oil and Table Olives, 2015 (the ‘Agreement’) was concluded on behalf of the Union by means of Council Decision (EU) 2019/848 (1).
(5) It is appropriate to establish the position to be taken on the Union’s behalf within the Council of Members, as the decisions to be adopted will have legal effects on the Union by impacting the decisional balance within the Council of Members when decisions are not adopted by consensus in accordance with Article 10(4) of the Agreement,
HAS ADOPTED THIS DECISION:
The position to be taken on the Union’s behalf within the Council of Members of the International Olive Council (the ‘Council of Members’) during a future session thereof, or within the framework of a procedure for adoption of decisions by the Council of Members by exchange of correspondence, as regards the conditions for the accession of the Government of San Marino to the International Agreement on Olive Oil and Table Olives, 2015, is set out in the Annex to this Decision.
This Decision shall enter into force on the date of its adoption.

The Union shall support the accession of the Government of San Marino to the Agreement, at a future session of the Council of Members or within the framework of a procedure for adoption by the Council of Members by exchange of correspondence, provided that the participation shares of San Marino are calculated according to the formula specified in Article 11 of the Agreement and that the time limit for the deposit of the instrument of accession does not exceed 18 months following the decision of the Council of Members. If the deposit of the instrument of accession is delayed, the Union may support, in subsequent decisions to be adopted by the Council of Members, the extension of the time limit for the deposit of the instrument of accession.

Commission Implementing Decision (EU) 2024/2712 of 23 October 2024 on the unresolved objections regarding the conditions for granting an authorisation for the biocidal product Phenogen in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (notified under document C(2024) 7275)

Official Journalof the European Union ENL series
2024/2712 28.10.2024
(1) On 23 April 2019, the company Synthèse élevage SARL (‘the applicant’) submitted an application for the mutual recognition in parallel, in accordance with Article 34 of Regulation (EU) No 528/2012, of the biocidal product Phenogen identified by the case numbers BC-DV051147-24, BC-WW051333-08, BC-VN051246-22, BC-DN051247-38, BC-DG051329-48 (‘the product’). The product is a disinfectant of product-type 3 to be used by professionals for disinfection of livestock housings, equipment, and transportation vehicles, and contains as active substances chlorocresol and L(+) lactic acid. France is the reference Member State responsible for the evaluation of the application as referred to in Article 34(1) of Regulation (EU) No 528/2012.
(2) On 26 November 2021, Germany referred objections to the coordination group pursuant to Article 35(2) of Regulation (EU) No 528/2012, indicating that the conditions of the authorisation set by France do not ensure that the product meets the conditions laid down in Article 19(1), point (b)(iii) and point (e), of that Regulation.
(3) Germany considers that the dietary risk assessment for consumers performed by France does not ensure that the condition laid down in Article 19(1), point (b)(iii) of Regulation (EU) No 528/2012 is met, since the experimental data from chlorocresol residue studies in pigs and poultry (‘the experimental data’) used for the refinement of livestock exposure assessment were not suitable, as metabolites of chlorocresol were not measured, and as only one of the three studies presented in the application for product authorisation covers the application rate of the product. Germany considers that when experimental data are not used for the refinement of the risk assessment, it cannot be excluded that the residues of chlorocresol in edible tissues will exceed the maximum residue level (MRL) of 0,01 mg/kg established for chlorocresol in accordance with Article 18(1), point (b), of Regulation (EC) No 396/2005 of the European Parliament and of the Council(2). France considers it unlikely that metabolites will be produced during the use of the product due to the properties of chlorocresol. France pointed out that the experimental data were used for the assessment of the application for approval of the active substance to conclude that no residues were expected in livestock edible tissues after use of chlorocresol at a rate of 2 000 mg/m2, whereas the application rate for the product is lower than the one assessed for the approval of chlorocresol, namely maximum of 1 200 mg/m2. France confirmed that, when the experimental data are not considered, the estimation of residues of chlorocresol in edible tissues when using the European Food Safety Authority (EFSA) Pesticide Residue Intake Model (PRIMo model)(3)exceeds the MRL of 0,01 mg/kg established for chlorocresol in accordance with Article 18(1), point (b), of Regulation (EC) No 396/2005. To ensure that the MRL for chlorocresol in edible tissues is not exceeded by the use of the product, Germany proposed as a risk mitigation measure the rinsing of surfaces with water after the application of the product and proposed that, in the absence of experimental studies regarding efficacy of rinsing, a default factor of 90 % be used for efficacy of rinsing for water soluble compounds including chlorocresol. France disagreed as it considers that the efficacy of rinsing was not supported by experimental data; moreover, in the instruction for use provided in the application for authorisation of the product, the applicant included the following instruction: ‘the surfaces must not be rinsed after application’.
(4) The second point of disagreement raised by Germany concerns the dermal absorption value used by France for the assessment of exposure of livestock. Germany considers that the default dermal absorption value for water-based dilutions of 50 % established in the EFSA guidance on dermal absorption(4)only applies to human skin and is not applicable by analogy to animals. As there is no data on livestock dermal absorption, France believes that the dermal absorption value of 50 % should be used for livestock as it represents the worst case scenario, and points out that the dermal absorption value of 50 % was used for the evaluation of the application for approval of chlorocresol. To refine the assessment on exposure of livestock, Germany proposed the application of a default transfer coefficient for dislodgeable residues transferred from treated surfaces as established in the European Chemicals Agency (ECHA) Human Health Exposure Methodology(5), and the application of empirical transfer factors from a study by Leeman et al. (2007), as established in the European Medicines Agency guideline on risk characterisation and assessment of maximum residue limits for biocides(6)to estimate the maximum transfer of an external oral dose to livestock edible tissues. France considers that even considering those two refinement factors, the estimation of residues in edible tissues exceeds the MRL of 0,01 mg/kg established for chlorocresol in accordance with Article 18(1), point (b), of Regulation (EC) No 396/2005.
(5) As the coordination group did not reach an agreement, on 17 May 2022, France referred the unresolved objections to the Commission pursuant to Article 36(1) of Regulation (EU) No 528/2012, and provided the Commission with a detailed statement of the matter on which Member States were unable to reach agreement and the reasons for their disagreement. That statement was forwarded to the Member States concerned and the applicant.
(6) On 21 November 2022, the Commission requested ECHA to determine whether the experimental data submitted in the application for approval of chlorocresol can be used for the refinement of livestock exposure assessment to the product, and to assess the risks for consumers and whether the use of the product would lead to an exceedance of the MRL of 0,01 mg/kg established in accordance with Article 18(1), point (b), of Regulation (EC) No 396/2005. ECHA was also requested to determine the dermal absorption value to be used for the livestock exposure assessment of the product and to assess the risks for consumers using that value and whether the use of the product considering that value would lead to an exceedance of the MRL of 0,01 mg/kg.
(7) The Commission also requested ECHA to determine the consequences of the refinements proposed by Germany as regards the residue levels in edible tissues and the potential risks for consumers.
(8) On 2 March 2023, the Biocidal Products Committee of ECHA adopted its opinion(7).
(9) ECHA considers that the experimental data can be used for the refinement of livestock exposure assessment to the product, and those data lead to the conclusion that there would be no exceedance of the MRL of 0,01 mg/kg , even if the rate of application of the product is covered by only one of the studies, provided that rinsing of the surfaces on which the product is applied before letting the animals enter the facilities is required in the instructions for use. ECHA is of the opinion that although there is no study measuring the efficacy of rinsing to reduce the levels of chlorocresol on the treated surface, it is reasonable to assume a 90 % reduction. ECHA confirmed that the experimental data used for the assessment of the application for approval of chlorocresol lead to the conclusion that no residues were expected in livestock edible tissues after use of chlorocresol at a rate of 2 000 mg/m2. However, two of the studies were performed using an application rate 10 times lower than the one intended for the product while in the third study, the application rate was 1,5 times higher than the one intended for the product. Furthermore, the assessment report for the approval of chlorocresol(8)indicates that an updated assessment of the risk in food and feed areas may be required at product authorisation stage.
(10) ECHA suggested that a protection factor for furs and feathers of 50 % can be used, whereas the livestock dermal absorption value should be 100 %. According to ECHA, when considering the experimental data, the 50 % systemic availability and residues transfer coefficient of chlorocresol and the 100 % dermal absorption value for livestock, the MRL of 0,01 mg/kg would not be exceeded.
(11) ECHA pointed out that, even without considering the experimental data, the consumer exposure does not exceed the acceptable daily intake of chlorocresol established in the active substance assessment report of 0,3 mg/kg of body weight.
(12) Article 19(1), point (b)(iii), of Regulation (EU) No 528/2012 establishes as a condition for authorisation that a biocidal product has no immediate or delayed unacceptable effects itself, or as a result of its residues, on the health of humans, including that of vulnerable groups, or animals, directly or through drinking water, food, feed, air, or through other indirect effects, while Article 19(1), point (e), of that Regulation provides that biocidal products are to be authorised provided that, where appropriate, MRLs for food and feed or specific migration limits or limits for the residual content in food contact materials have been established in accordance with relevant Union legislation.
(13) Article 18(1), point (b), of Regulation (EC) No 396/2005 sets a default MRL of 0,01 mg/kg for pesticide residues in food of animal origin for which no specific MRLs are set. According to Article 3(2), point (c), of that Regulation, pesticide residues are residues, including active substances, metabolites and/or breakdown or reaction products of active substances currently or formerly used in plant protection products as defined in Article 2, point 1, of Council Directive 91/414/EEC(9), which are present in or on the products covered by Annex I to Regulation (EC) No 396/2005, including in particular those which may arise as a result of use in plant protection, in veterinary medicine and as a biocide. After analysis, it appears that chlorocresol was never used as an active substance in plant protection products under Directive 91/414/EEC or Regulation (EC) No 1107/2009 of the European Parliament and of the Council(10). As there is no evidence that chlorocresol is currently or was formerly used in plant protection products, the Commission concludes that chlorocresol does not fall within the scope of Regulation (EC) No 396/2005 and that the default value of 0.01 mg/kg set out in Article 18(1), point (b), of that Regulation does not apply to the biocidal active substance chlorocresol.
(14) The active substance chlorocresol is used as a biocide in animal husbandry, and is classified as a substance for which no MRL is required pursuant to Commission Regulation (EU) No 37/2010(11). Chlorocresol has indeed been evaluated by the Committee for Veterinary Medicinal Products which has concluded(12)that there is no need to establish a MRL for chlorocresol in all food-producing species as chlorocresol is considered to have low toxicity, is rapidly metabolised and excreted, with no potential to accumulate in tissues and has been safely used in human medicine for many years.
(15) Taking into account the arguments raised by France, Germany and the ECHA opinion, the Commission considers that the product meets the condition laid down in Article 19(1), point (b)(iii), of Regulation (EU) No 528/2012, as there is no dietary risk for the consumer arising from the use of the product considering that the consumer exposure does not exceed the acceptable daily intake of chlorocresol. For the same reason, the Commission also considers that it is not necessary that the instruction to rinse surfaces in which the product has been applied before letting the animals enter the facilities, is included in the summary of product characteristics.
(16) The Commission considers that the product also meets the condition set in Article 19(1), point (e), of Regulation (EU) No 528/2012 as chlorocresol is classified as a substance for which no MRL is required pursuant to Regulation (EU) No 37/2010 and is not within the scope of Regulation (EC) No 396/2005.
(17) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Biocidal Products,
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular Article 36(3) thereof,
Whereas:
Germany considers that when experimental data are not used for the refinement of the risk assessment, it cannot be excluded that the residues of chlorocresol in edible tissues will exceed the maximum residue level (MRL) of 0,01 mg/kg established for chlorocresol in accordance with Article 18(1), point (b), of Regulation (EC) No 396/2005 of the European Parliament and of the Council (2). France considers it unlikely that metabolites will be produced during the use of the product due to the properties of chlorocresol. France confirmed that, when the experimental data are not considered, the estimation of residues of chlorocresol in edible tissues when using the European Food Safety Authority (EFSA) Pesticide Residue Intake Model (PRIMo model) (3) exceeds the MRL of 0,01 mg/kg established for chlorocresol in accordance with Article 18(1), point (b), of Regulation (EC) No 396/2005. (4) The second point of disagreement raised by Germany concerns the dermal absorption value used by France for the assessment of exposure of livestock.
(8) On 2 March 2023, the Biocidal Products Committee of ECHA adopted its opinion (7).
(11) ECHA pointed out that, even without considering the experimental data, the consumer exposure does not exceed the acceptable daily intake of chlorocresol established in the active substance assessment report of 0,3 mg/kg of body weight.
