Council Decision (EU) 2024/2957 of 21 November 2024 on the position to be adopted on behalf of the European Union within the Joint Committee established by the Agreement between European Economic Community and the Swiss Confederation, with regard to a decision concerning the amendment of Protocol 3 to that Agreement as regards permeability between the Regional Convention on pan-Euro-Mediterranean preferential rules of origin and the Transitional rules of origin

Official Journalof the European Union ENL series
2024/2957 29.11.2024
(1) The Agreement between the European Economic Community and the Swiss Confederation (the ‘Agreement’) was concluded by the Union by Council Regulation (EEC) No 2840/72(1)and entered into force on 1 January 1973.
(2) Pursuant to Article 29 of the Agreement, the Joint Committee established under that Article (the ‘Joint Committee’) may take decisions in the cases provided for in the Agreement. Pursuant to Article 4 of Protocol 3 to the Agreement, the Joint Committee may decide to amend the provisions of that Protocol.
(3) At its next meeting, the Joint Committee is to take a decision on an amendment of Protocol 3 to the Agreement.
(4) It is appropriate to establish the position to be adopted on the Union’s behalf within the Joint Committee as the decision of the Joint Committee will have legal effects.
(5) The Regional Convention on pan-Euro-Mediterranean preferential rules of origin (the ‘Convention’) was concluded by the Union by Council Decision 2013/94/EU(2)and entered into force in relation to the Union on 1 May 2012. By Decision (EU) 2019/2198(3), the Council supported the amendment of the Convention providing for a new set of modernised and more flexible rules of origin (the ‘amendment of the Convention’). The amendment of the Convention will enter into force on 1 January 2025.
(6) At the technical meeting held in Brussels on 5 February 2020, the majority of the Contracting Parties to the Convention agreed to implement an alternative set of rules of origin based on the amendment of the Convention on a transitional, bilateral basis (the ‘Transitional rules’). The Transitional rules apply in parallel with the rules of the Convention, pending the entry into force of the amendment of the Convention.
(7) The application of the Transitional rules ensures the adaptation of the trade flows and customs practices pending the entry into force of the amendment of the Convention.
(8) Since 1 September 2021, a number of bilateral protocols on rules of origin among several Contracting Parties to the Convention(4)have entered into force, rendering the Transitional rules applicable. As regards the Swiss Confederation (‘Switzerland’), Protocol 3 to the Agreement was replaced by a new Protocol 3 by Decision No 2/2021 of the EU-Switzerland Joint Committee(5). The Transitional rules are set out in Appendix A to that new Protocol 3.
(9) The objective of the Transitional rules is to provide for less strict rules, making it easier for goods to qualify for preferential originating status. As the Transitional rules are, in general, less strict than those of the Convention, goods fulfilling the rules of origin set out in the Convention could also qualify as originating under the Transitional rules, with the exception of certain agricultural products classified under Chapters 2, 4 to 15 and 16 (except for processed fishery products) and Chapters 17 to 24 of the Harmonized Commodity Description and Coding System. The Transitional rules are applicable in parallel with the rules of origin set out in the Convention, thus creating two distinct zones of cumulation of origin. In that context, it can happen that goods fall under both sets of rules of origin simultaneously. According to the principle of permeability under Article 21(1), point (d), of Appendix A to Protocol 3 to the Agreement (‘permeability’), goods which have acquired originating status under one set of rules of origin can be also considered as originating under the other set of rules of origin. In order to facilitate the application of permeability between the Convention and the Transitional rules, Article 8 of Appendix A to Protocol 3 to the Agreement should be amended.
(10) The position of the Union within the Joint Committee should therefore be based on the attached draft decision,

Commission Decision (EU) 2024/2951 of 29 November 2024 on the Union-wide quantity of allowances to be issued under the EU ETS for buildings, road transport and additional sectors for 2027

Official Journalof the European Union ENL series
2024/2951 3.12.2024
(1) In accordance with Article 30c(1) of Directive 2003/87/EC, the Commission is to publish, by 1 January 2025, the Union-wide quantity of allowances issued under Chapter IVa of that Directive for the year 2027.
(2) Pursuant to Article 30c(1) of Directive 2003/87/EC, the Union-wide quantity of allowances is to be determined by reference to the value of the 2024 emission limits, calculated on the basis of the reference emissions under Article 4(2) of Regulation (EU) 2018/842 of the European Parliament and of the Council(2)for the sectors covered by Chapter IVa of Directive 2003/87/EC, and by applying the linear reduction trajectory for all emissions within the scope of that Regulation.
(3) The emission limits for 2024 according to Article 4(2) of Regulation (EU) 2018/842 are defined by a linear trajectory from 2022 to 2030, starting at the 2022 emission limits, which in turn are defined under that Regulation by a linear trajectory that is based on the average of each Member States’ greenhouse gas emissions in 2016, 2017 and 2018.
(4) Pursuant to Article 4(3), second subparagraph of Regulation (EU) 2018/842, the annual emission allocations in accordance with the 2022 emission limits are determined on the basis of the comprehensively reviewed national greenhouse gas inventory data for the years 2016, 2017 and 2018, submitted by Member States pursuant to Article 7 of Regulation (EU) No 525/2013(3).
(5) The reference emissions for sectors covered by Chapter IVa of Directive 2003/87/EC were established on the basis of the arithmetic average of the comprehensively reviewed national greenhouse gas inventory data for the years 2016, 2017 and 2018.
(6) The reference emissions for sectors covered by Chapter IVa of Directive 2003/87/EC include the EEA EFTA States, in accordance with the Decision of the EEA Joint Committee No 335/2023(4).
(7) The carbon dioxide emissions from activities explicitly excluded under Annex III to Directive 2003/87/EC were deducted from the comprehensively reviewed carbon dioxide emission values of the national inventories. Furthermore, Annex III to Directive 2003/87/EC provides for modifications to source categories 1A1 and 1A3b, as defined in the 2006 IPCC Guidelines for National Greenhouse Gas Inventories(5). These modifications were taken into account to calculate the value of the reference emissions for sectors covered by Chapter IVa of Directive 2003/87/EC.
(8) The 2024 emission limits for the sectors covered by Chapter IVa of Directive 2003/87/EC were calculated by applying to the reference emissions a linear reduction trajectory based on all emissions within the scope of Regulation (EU) 2018/842, starting at their average in 2016, 2017 and 2018 and ending at the 2024 emission limits under that Regulation, on the basis of the 2024 emission allocations published in Annex II of the Commission Implementing Decision (EU) 2023/1319(6). On this basis, the 2024 emission limits referred to in Article 30c(1) of Directive 2003/87/EC should amount to 1 223 481 445 tonnes of carbon dioxide.
(9) Pursuant to Article 30c(1) of Directive 2003/87/EC, the Union-wide quantity of allowances issued for 2027 under Chapter IVa of Directive 2003/87/EC is to decrease each year after 2024 by a linear reduction factor of 5,10 %. On this basis, the Union-wide quantity of allowances for 2027 referred to in Article 30c(1) of Directive 2003/87/EC should amount to 1 036 288 784,
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive 2003/87/EC of the European Parliament and of the Council of 13 October 2003 establishing a system for greenhouse gas emission allowance trading within the Union and amending Council Directive 96/61/EC (1), and in particular Article 30c(1) thereof,
Whereas:
(1) In accordance with Article 30c(1) of Directive 2003/87/EC, the Commission is to publish, by 1 January 2025, the Union-wide quantity of allowances issued under Chapter IVa of that Directive for the year 2027.
(2) Pursuant to Article 30c(1) of Directive 2003/87/EC, the Union-wide quantity of allowances is to be determined by reference to the value of the 2024 emission limits, calculated on the basis of the reference emissions under Article 4(2) of Regulation (EU) 2018/842 of the European Parliament and of the Council (2) for the sectors covered by Chapter IVa of Directive 2003/87/EC, and by applying the linear reduction trajectory for all emissions within the scope of that Regulation.
(4) Pursuant to Article 4(3), second subparagraph of Regulation (EU) 2018/842, the annual emission allocations in accordance with the 2022 emission limits are determined on the basis of the comprehensively reviewed national greenhouse gas inventory data for the years 2016, 2017 and 2018, submitted by Member States pursuant to Article 7 of Regulation (EU) No 525/2013 (3).
(5) The reference emissions for sectors covered by Chapter IVa of Directive 2003/87/EC were established on the basis of the arithmetic average of the comprehensively reviewed national greenhouse gas inventory data for the years 2016, 2017 and 2018.
(6) The reference emissions for sectors covered by Chapter IVa of Directive 2003/87/EC include the EEA EFTA States, in accordance with the Decision of the EEA Joint Committee No 335/2023 (4).
(7) The carbon dioxide emissions from activities explicitly excluded under Annex III to Directive 2003/87/EC were deducted from the comprehensively reviewed carbon dioxide emission values of the national inventories. Furthermore, Annex III to Directive 2003/87/EC provides for modifications to source categories 1A1 and 1A3b, as defined in the 2006 IPCC Guidelines for National Greenhouse Gas Inventories (5). These modifications were taken into account to calculate the value of the reference emissions for sectors covered by Chapter IVa of Directive 2003/87/EC.
(8) The 2024 emission limits for the sectors covered by Chapter IVa of Directive 2003/87/EC were calculated by applying to the reference emissions a linear reduction trajectory based on all emissions within the scope of Regulation (EU) 2018/842, starting at their average in 2016, 2017 and 2018 and ending at the 2024 emission limits under that Regulation, on the basis of the 2024 emission allocations published in Annex II of the Commission Implementing Decision (EU) 2023/1319 (6).
On this basis, the Union-wide quantity of allowances for 2027 referred to in Article 30c(1) of Directive 2003/87/EC should amount to 1 036 288 784,
HAS ADOPTED THIS DECISION:
For 2027, the Union-wide quantity of allowances referred to in Article 30(c)(1) of Directive 2003/87/EC shall amount to 1 036 288 784.
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

Commission Implementing Decision (EU) 2024/2950 of 29 November 2024 postponing the expiry date of the approval of N,N-diethyl-meta-toluamide for use in biocidal products of product-type 19 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council

Official Journalof the European Union ENL series
2024/2950 3.12.2024
(1) N,N-diethyl-meta-toluamide was included in Annex I to Directive 98/8/EC of the European Parliament and of the Council(2)as an active substance for use in biocidal products of product-type 19, subject to the conditions set out in that Annex.
(2) In accordance with Article 86 of Regulation (EU) No 528/2012, N,N-diethyl-meta-toluamide was deemed to have been approved under that Regulation on the date of its inclusion in Annex I to Directive 98/8/EC of the European Parliament and of the Council. That approval was to expire on 31 July 2022.
(3) On 26 January 2021, an application was submitted in accordance with Article 13(1) of Regulation (EU) No 528/2012 for the renewal of the approval of N,N-diethyl-meta-toluamide for use in biocidal products of product-type 19 (‘the application’).
(4) On 4 June 2021, the evaluating competent authority of France informed the Commission that it had decided, pursuant to Article 14(1) of Regulation (EU) No 528/2012, that a full evaluation of the application was necessary. Pursuant to Article 8(1) of that Regulation, the evaluating competent authority is to perform a full evaluation of the application within 365 days of its validation.
(5) The evaluating competent authority may, as appropriate, require the applicant to provide sufficient data to carry out the evaluation, in accordance with Article 8(2) of Regulation (EU) No 528/2012. In that event, the 365-day period is suspended for a period that may not exceed 180 days in total unless a longer suspension is justified by the nature of the data requested or by exceptional circumstances.
(6) Within 270 days of receipt of a recommendation from the evaluating competent authority, the European Chemicals Agency (‘the Agency’) is to prepare and submit to the Commission an opinion on renewal of the approval of the active substance in accordance with Article 14(3) of Regulation (EU) No 528/2012.
(7) Commission Implementing Decision (EU) 2021/2146(3)postponed the expiry date of the approval of N,N-diethyl-meta-toluamide for use in biocidal products of product-type 19 to 31 January 2025, in order to allow sufficient time for the examination of the application.
(8) On 26 June 2024, the evaluating competent authority informed the Commission that it expects to submit the renewal assessment report to the Agency in the third quarter of 2025.
(9) Consequently, for reasons beyond the control of the applicant, the approval is likely to expire before a decision has been taken on its renewal. It is therefore appropriate to further postpone the expiry date of the approval for a period of time sufficient to finalise the examination of the application. Taking into account the time-limits for evaluation by the evaluating competent authority, for the preparation and submission by the Agency of its opinion, and the time needed for the Commission to decide whether the approval of N,N-diethyl-meta-toluamide for use in biocidal products of product-type 19 may be renewed, the expiry date should be postponed to 31 January 2027.
(10) After the further postponement of the expiry date of the approval, N,N-diethyl-meta-toluamide remains approved for use in biocidal products of product-type 19 subject to the conditions set out in Annex I to Directive 98/8/EC,
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular Article 14(5) thereof,
After consulting the Standing Committee on Biocidal Products,
Whereas:
(1) N,N-diethyl-meta-toluamide was included in Annex I to Directive 98/8/EC of the European Parliament and of the Council (2) as an active substance for use in biocidal products of product-type 19, subject to the conditions set out in that Annex.
(7) Commission Implementing Decision (EU) 2021/2146 (3) postponed the expiry date of the approval of N,N-diethyl-meta-toluamide for use in biocidal products of product-type 19 to 31 January 2025, in order to allow sufficient time for the examination of the application.
(10) After the further postponement of the expiry date of the approval, N,N-diethyl-meta-toluamide remains approved for use in biocidal products of product-type 19 subject to the conditions set out in Annex I to Directive 98/8/EC,
HAS ADOPTED THIS DECISION:
The expiry date of the approval of N,N-diethyl-meta-toluamide for use in biocidal products of product-type 19 set out in Annex I to Directive 98/8/EC is postponed to 31 January 2027.
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

Commission Implementing Decision (EU) 2024/2946 of 29 November 2024 not granting a Union authorisation for the biocidal product family BPF H2O2 HAG in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (notified under document C(2024) 8356)

Official Journalof the European Union ENL series
2024/2946 2.12.2024
(1) On 26 January 2017, Hagleitner Hygiene International GmbH submitted to the European Chemicals Agency (‘the Agency’) an application in accordance with Article 43(1) of Regulation (EU) No 528/2012 for Union authorisation of a biocidal product family named ‘BPF H2O2 HAG’ of product-type 4, as described in Annex V to that Regulation, providing written confirmation that the competent authority of Austria had agreed to evaluate the application. The application was recorded under case number BC-RV029472-09 in the Register for Biocidal Products.
(2) ‘BPF H2O2 HAG’ contains hydrogen peroxide as the active substance, which is included in the Union list of approved active substances referred to in Article 9(2) of Regulation (EU) No 528/2012 for product-type 4.
(3) On 30 November 2023, the evaluating competent authority submitted, in accordance with Article 44(1) of Regulation (EU) No 528/2012, an assessment report and the conclusions of its evaluation to the Agency. Prior to that submission to the Agency, on 13 October 2023, Hagleitner Hygiene International GmbH was given the opportunity to provide written comments on the draft assessment report and the conclusions within 30 days, in accordance with Article 44(1), second subparagraph, of Regulation (EU) No 528/2012. Hagleitner Hygiene International GmbH provided comments on 11 November 2023. The evaluating competent authority took due account of the comments when finalising its evaluation and provided responses to the comments on 29 November 2023.
(4) During the Agency’s opinion-forming process, Hagleitner Hygiene International GmbH was given the opportunity to be involved in the process in accordance with the Agency’s working procedure for Union authorisation applications(2). On 29 May 2024, the final opinion was adopted by the Biocidal Products Committee of the Agency(3).
(5) On 26 June 2024, the Agency submitted to the Commission its opinion on the application for Union authorisation of ‘BPF H2O2 HAG’ together with the assessment report, in accordance with Article 44(3) of Regulation (EU) No 528/2012. The Agency concludes in that opinion that ‘BPF H2O2 HAG’ falls within the definition of a biocidal product family laid down in Article 3(1), point (s), of Regulation (EU) No 528/2012, and is, in principle, eligible for Union authorisation in accordance with Article 42(1) of that Regulation but that it does not meet the conditions laid down in Article 19(1), point (b)(i), Article 19(1), point (d), Article 19(3) and Article 19(6) of that Regulation.
(6) In particular, the Agency considers that sufficient efficacy as required by Article 19(1), point (b)(i), of Regulation (EU) No 528/2012 is not shown due to the lack of relevant efficacy studies demonstrating sufficient efficacy at the intended concentration under required conditions. In addition, it could not be concluded that the physical and chemical properties of the biocidal product family have been determined and deemed acceptable for the purpose of the appropriate use and transport of the products in accordance with Article 19(1), point (d), of Regulation (EU) No 528/2012, with regard to acidity/alkalinity, long term storage stability, degree of dissolution and dilution stability, and due to a lack of information allowing for a conclusion on the corrosiveness to metals and on the auto-ignition temperature for the biocidal product family. Due to the missing data on the efficacy and physico-chemical properties, it is considered that information for the relevant use of the products has not been submitted in accordance with Article 20 of Regulation (EU) No 528/2012, as required by Article 19(3) of that Regulation. The conditions for the authorisation of a biocidal product family laid down in Article 19(6) of Regulation (EU) No 528/2012 are not considered to be fulfilled since sufficient efficacy of the biocidal product family ‘BPF H2O2 HAG’ was not proven for the intended use. The Agency therefore proposes not to authorise the biocidal product family ‘BPF H2O2 HAG’.
(7) The Commission concurs with the opinion of the Agency and considers that ‘BPF H2O2 HAG’ does not meet the conditions laid down in Article 19(1), point (b)(i), Article 19(1), point (d), in conjunction with Article 19(6) of Regulation (EU) No 528/2012. It is therefore appropriate to not grant a Union authorisation for ‘BPF H2O2 HAG’.
(8) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Biocidal Products,
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular Article 44(5), first subparagraph, thereof,
Whereas:
(4) During the Agency’s opinion-forming process, Hagleitner Hygiene International GmbH was given the opportunity to be involved in the process in accordance with the Agency’s working procedure for Union authorisation applications (2). On 29 May 2024, the final opinion was adopted by the Biocidal Products Committee of the Agency (3).
(8) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Biocidal Products,
HAS ADOPTED THIS DECISION:
A Union authorisation is not granted to Hagleitner Hygiene International GmbH for the making available on the market and use of the biocidal product family ‘BPF H2O2 HAG’.

As a result, CEN adopted the following revised harmonised standards, respectively: EN 30-1-1:2021+A1:2023, EN 30-1-2:2023+A1:2024, EN 88-1:2022+A1:2023, EN 203-1:2021+A1:2023, EN 203-2-1:2021+A1:2023, EN 203-2-2:2021+A1:2023, EN 203-2-4:2021+A1:2023, EN 257:2022+A1:2023, EN 549:2019+A2:2024, EN 751-3:2022+A1:2023, EN 1106:2022+A1:2023, EN 1854:2022+A1:2023, EN 15502-1:2021+A1:2023, EN 15502-2-1:2022+A1:2023 and EN 16898:2022+A1:2023.
(4) The Commission, together with CEN, has assessed whether the harmonised standards revised by CEN comply with the request set out in Implementing Decision C(2023)4789.
(5) The reference of harmonised standard EN 30-1-1:2021 on the general safety for domestic cooking appliances burning gas was published by Implementing Decision (EU) 2024/224 with restrictions. Harmonised standard EN 30-1-1:2021+A1:2023 does not address those restrictions.
(6) The harmonised standards revised by CEN on the basis of the request set out in Implementing Decision C(2023)4789, except for harmonised standard EN 30-1-1:2021+A1:2023, satisfy the requirements which they aim to cover and which are set out in Annex I to Regulation (EU) 2016/426. It is therefore appropriate to publish the references of those standards in theOfficial Journal of the European Union.
(7) Harmonised standard EN 30-1-1:2021+A1:2023 satisfies the requirements which it aims to cover and which are set out in Annex I to Regulation (EU) 2016/426, except for the requirements set out in points 3.2.4 and 3.4.4 of Annex I to Regulation (EU) 2016/426. It is therefore appropriate to publish the reference of that standard in theOfficial Journal of the European Unionwith restrictions.
(8) In the interests of clarity, rationality and simplification, a complete list of references of harmonised standards drafted in support of Regulation (EU) 2016/426 and satisfying the requirements they aim to cover should be published in a single act. The references of harmonised standards drafted in support of Regulation (EU) 2016/426 are currently published by Implementing Decision (EU) 2024/224. Consequently, it is necessary to replace Implementing Decision (EU) 2024/224 by a new decision.
(9) Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in theOfficial Journal of the European Union. This Decision should therefore enter into force on the date of its publication,
