Commission Implementing Decision (EU) 2025/337 of 20 February 2025 on the harmonised standards for pyrotechnic articles drafted in support of Directive 2013/29/EU of the European Parliament and of the Council

Official Journalof the European Union ENL series
2025/337 24.2.2025
(1) In accordance with Article 16 of Directive 2013/29/EU of the European Parliament and of the Council(2), pyrotechnic articles that are in conformity with the relevant harmonised standards or the relevant parts thereof, the references of which have been published in theOfficial Journal of the European Union, are to be presumed to be in conformity with the essential safety requirements set out in Annex I to that Directive.
(2) On 14 August 2007, the Commission issued standardisation request M/416 to support Directive 2007/23/EC of the European Parliament and of the Council(3)to the European Committee for Standardization (CEN). In that request, the Commission invited CEN to draw up fireworks standards containing, among others, a list of articles falling under category P1 (pyrotechnic articles, other than fireworks and theatrical pyrotechnic articles, which present a low hazard), a list of articles which do not fall under that category as well as a procedure or criteria which determine which article falls under category P1. References to the standards adopted by CEN in response to that request were published in theOfficial Journal of the European Unionon 12 May 2017 by means of Commission Communication 2017/C 149/01(4), which replaced all the previous lists published in theOfficial Journal of the European Union.
(3) By Commission Implementing Decision C(2022) 3011(5)the Commission made a request to CEN for the revision of existing harmonised standards on pyrotechnic articles in support of Directive 2013/29/EU, which replaced and repealed Directive 2007/23/EC. In accordance with that Implementing Decision the standardisation mandate M/416 expired on 13 June 2022.
(4) CEN revised the harmonised standards EN 15947-1:2015, EN 15947-2:2015, EN 15947-3:2015, EN 15947-4:2015 and EN 15947-5:2015, still on the basis of the standardisation mandate M/416 and adopted the new standards series EN 15947:2022, parts 1 to 5, on 5 October 2022. Those new standards superseded EN 15947:2015 series (parts 1 to 5). However, only parts 2 to 5 of the EN 15947:2022 series were submitted by CEN to the Commission for citation in theOfficial Journal of the European Union, as part 1 containing definitions of terminology, was considered not to be part of the presumption of conformity with any of the essential safety requirements of Directive 2013/29/EU.
(5) By letter of 21 November 2023, the Commission informed CEN about its intention not to reference in theOfficial Journal of the European Unionthe standards EN 15947-2:2022, EN 15947-3:2022, EN 15947-4:2022 and EN 15947-5:2022, due to the fact that those standards do not satisfy the requirements set out in the standardisation request of Implementing Decision C(2022) 3011 and therefore do not implement the relevant essential safety requirements laid down in Directive 2013/29/EU.
(6) Given that CEN considers the standards EN 15947-2:2022, EN 15947-3:2022, EN 15947-4:2022 and EN 15947-5:2022 to supersede the existing, currently cited standards (EN 15947-2:2015, EN 15947-3:2015, EN 15947-4:2015 and EN 15947-5:2015) those standards cannot be considered any longer to represent the state of the art and to satisfy the relevant essential safety requirements, also against the background that CEN confirmed its inability to develop and submit new standards in the near future. It is therefore necessary to withdraw the references to harmonised standards series EN 15947:2015 from theOfficial Journal of the European Union,as those standards have been revised by CEN and superseded by standards series EN 15947:2022.
(7) As the definitions of terminology provided in the standards EN ISO 14451-1:2013, EN 15947-1:2015, EN 16256-1:2012 and EN 16261-1:2012, do not support any of the essential safety requirements laid down in Directive 2013/29/EU, it is therefore necessary to withdraw the references to those harmonised standards from theOfficial Journal of the European Union.
(8) In the interests of clarity and transparency, a new complete list of references to harmonised standards adopted in support of Directive 2013/29/EU and satisfying the requirements they aim to cover should be published in a single act.
(9) It is therefore appropriate to repeal Communication 2017/C 149/01.
(10) Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in theOfficial Journal of the European Union. This Decision should therefore enter into force on the date of its publication.
(11) The harmonised standards adopted in response to the standardisation requests may be subject to access to documents requests in accordance with Regulation (EC) No 1049/2001 of the European Parliament and of the Council(6). In its judgement of 5 March 2024 in Case C-588/21 P(7),Public.Resource.Org and Right to Know v Commission and Others,the Court recognised that there is an overriding public interest, within the meaning of Article 4(2) of Regulation (EC) No 1049/2001, justifying the disclosure of harmonised standards,

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 10(6) thereof,
Whereas:
(1) In accordance with Article 16 of Directive 2013/29/EU of the European Parliament and of the Council (2), pyrotechnic articles that are in conformity with the relevant harmonised standards or the relevant parts thereof, the references of which have been published in the Official Journal of the European Union, are to be presumed to be in conformity with the essential safety requirements set out in Annex I to that Directive.
(2) On 14 August 2007, the Commission issued standardisation request M/416 to support Directive 2007/23/EC of the European Parliament and of the Council (3) to the European Committee for Standardization (CEN). References to the standards adopted by CEN in response to that request were published in the Official Journal of the European Union on 12 May 2017 by means of Commission Communication 2017/C 149/01 (4), which replaced all the previous lists published in the Official Journal of the European Union.
(3) By Commission Implementing Decision C(2022) 3011 (5) the Commission made a request to CEN for the revision of existing harmonised standards on pyrotechnic articles in support of Directive 2013/29/EU, which replaced and repealed Directive 2007/23/EC.
However, only parts 2 to 5 of the EN 15947:2022 series were submitted by CEN to the Commission for citation in the Official Journal of the European Union, as part 1 containing definitions of terminology, was considered not to be part of the presumption of conformity with any of the essential safety requirements of Directive 2013/29/EU.
(5) By letter of 21 November 2023, the Commission informed CEN about its intention not to reference in the Official Journal of the European Union the standards EN 15947-2:2022, EN 15947-3:2022, EN 15947-4:2022 and EN 15947-5:2022, due to the fact that those standards do not satisfy the requirements set out in the standardisation request of Implementing Decision C(2022) 3011 and therefore do not implement the relevant essential safety requirements laid down in Directive 2013/29/EU.
It is therefore necessary to withdraw the references to harmonised standards series EN 15947:2015 from the Official Journal of the European Union, as those standards have been revised by CEN and superseded by standards series EN 15947:2022.
(7) As the definitions of terminology provided in the standards EN ISO 14451-1:2013, EN 15947-1:2015, EN 16256-1:2012 and EN 16261-1:2012, do not support any of the essential safety requirements laid down in Directive 2013/29/EU, it is therefore necessary to withdraw the references to those harmonised standards from the Official Journal of the European Union.

(10) Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should therefore enter into force on the date of its publication.
(11) The harmonised standards adopted in response to the standardisation requests may be subject to access to documents requests in accordance with Regulation (EC) No 1049/2001 of the European Parliament and of the Council (6). In its judgement of 5 March 2024 in Case C-588/21 P (7), Public.Resource.Org and Right to Know v Commission and Others, the Court recognised that there is an overriding public interest, within the meaning of Article 4(2) of Regulation (EC) No 1049/2001, justifying the disclosure of harmonised standards,

(2) Article 15(1) of the Treaty on the Functioning of the European Union (TFEU) provides that, in order to promote good governance and ensure the participation of civil society, Union institutions, bodies, offices and agencies are to conduct their work as openly as possible.
(3) Title II of the Staff Regulations of Officials of the European Union and the Conditions of Employment of Other Servants of the Union, laid down in Council Regulation (EEC, Euratom, ECSC) No 259/68(2)lays down rights and obligations of officials, explicitly outlining their conduct and duties.
(4) Parliament is committed to ensuring its integrity, independence and accountability, which are essential for maintaining the trust of Union citizens in the legitimacy of the political, legislative and administrative processes of the Union. That commitment should be translated into specific requirements as regards the meetings of Parliament’s managers in active employment in its General Secretariat.
(5) The signatory institutions of the Interinstitutional Agreement of 20 May 2021 between the European Parliament, the Council of the European Union and the European Commission on a mandatory transparency register (‘the IIA on a mandatory transparency register’), committed themselves to ‘conditionality’, the principle whereby registration in the transparency register is a precondition for interest representatives to be able to carry out certain covered activities. The signatory institutions implement that principle by means of individual decisions on the basis of their powers of internal organisation.
(6) The principle of conditionality should apply to scheduled meetings relating to parliamentary business organised between interest representatives and managers in Parliament’s administration.
(7) Scheduled meetings of managers with interest representatives and with representatives of public authorities of third countries relating to parliamentary business should be declared and published as a means of ensuring an open, efficient and independent Parliament administration.
(8) Certain activities and bodies listed in Article 4 of the IIA on a mandatory transparency register fall outside the scope of that IIA and should therefore not be covered by the definition of ‘interest representative’ in this Decision.
(9) Citizens of the Union visiting Parliament’s premises, petitioners, and journalists participating in press conferences or other information activities organised for their benefit should not be considered to be ‘interest representatives’ as defined in this Decision. Likewise, general information sessions and communication activities by Parliament’s services that aim to reach out to audiences consisting of multipliers should not be considered to be scheduled meetings with interest representatives for the purposes of this Decision.
(10) In light of Parliament’s commitment to ensuring its integrity, independence and accountability and in accordance with Regulation (EU) No 2018/1725 of the European Parliament and of the Council(3), in particular Article 5(1)(a) thereof, it should be possible to publish the names of managers who have declared a scheduled meeting under this Decision,

Commission Implementing Decision (EU) 2025/323 of 11 February 2025 concerning certain emergency measures relating to foot and mouth disease in Germany and repealing Implementing Decision (EU) 2025/186 (notified under document C(2025) 1015)

Official Journalof the European Union ENL series
2025/323 12.2.2025
(1) Foot and mouth disease is an infectious viral disease affecting animals in the mammal order of Artiodactyla and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries.
(2) In the event of an outbreak of foot and mouth disease in animals of listed species, there is a serious risk of the spread of that disease to other establishments keeping animals of listed species.
(3) Commission Delegated Regulation (EU) 2020/687(2)supplements the rules for the control of the listed diseases referred to in Article 9(1), points (a), (b) and (c), of Regulation (EU) 2016/429, and defined as category A, B and C diseases in Commission Implementing Regulation (EU) 2018/1882(3). In particular, Articles 21 and 22 of Delegated Regulation (EU) 2020/687 provide for the establishment of a restricted zone in the event of an outbreak of a category A disease, including foot and mouth disease, and for certain measures to be applied therein. Article 21(1) of that Delegated Regulation provides that the restricted zone is to comprise a protection zone, a surveillance zone, and, if necessary, further restricted zones around or adjacent to the protection and surveillance zones.
(4) Commission Implementing Decision (EU) 2025/186(4)was adopted on the basis of Regulation (EU) 2016/429, and it lays down certain emergency measures relating to infection with foot and mouth disease virus in Germany in response to the outbreak confirmed on 10 January 2025 in the federal state of Brandenburg, close to that state’s border with the federal state of Berlin. More particularly, Implementing Decision (EU) 2025/186 provides that the protection and surveillance zones to be established by Germany in the federal state of Brandenburg, in accordance with Delegated Regulation (EU) 2020/687, following that outbreak are to comprise at least the areas listed in the Annex to that Implementing Decision.
(5) Since the adoption of Implementing Decision (EU) 2025/186, the emergency measures to be applied in the restricted zones, and the timeline for their implementation, have been reviewed. As a consequence, the duration of those measures needs to be extended. Therefore, the areas listed as protection and surveillance zones for Germany, should be defined both spatially and temporally in Annex I to this Implementing Decision, in order to prevent the spread of the disease in Germany and to the rest of the Union, as well as to third countries. Providing for clarity on the exact scope of these areas, as well as on the measures to be applied therein, by setting them out in a legal act of the Union is also required in order to avoid unjustified disruptions in the movements of animals and products in the Union, as well as to third countries.
(6) Furthermore, considering that the ongoing epidemiological investigation is still being conducted by the competent authority of Germany, and pending its conclusion, and in order to avoid any unjustified disruptions as regards the movements of animals and products in the Union, as well as to third countries, it is appropriate to apply further measures, namely those that are applicable to further restricted zones, as provided for in Delegated Regulation (EU) 2020/687, following the expiry of the emergency measures in the surveillance zone (the further measures). The further measures should be applied in an area defined both spatially and temporally in relation to the protection and surveillance zones foreseen before.
(7) Accordingly, in order to prevent any unnecessary disturbance to trade within the Union and to avoid any unjustified barriers to trade by third countries, it is necessary to rapidly review at Union level the measures applicable in the restricted zones for foot and mouth disease, which comprise protection and surveillance zones, as well as to provide for further measures to be applied, in the federal states of Berlin and Brandenburg in Germany in collaboration with that Member State.
(8) Implementing Decision (EU) 2025/186 should, therefore, be repealed and replaced by this Decision.
(9) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
(a) restricted zones, which comprise protection and surveillance zones are established immediately by the competent authority of that Member State in accordance with Article 21 of Delegated Regulation (EU) 2020/687, and under the conditions laid down in that Article;
(b) the protection and surveillance zones referred to in point (a) comprise at least the areas listed in Annex I to this Decision;
(c) the measures required to be applied in the protection, and surveillance zones, are applied at least until the dates listed in Annex I to this Decision.

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (c), thereof,
Whereas:
(1) Foot and mouth disease is an infectious viral disease affecting animals in the mammal order of Artiodactyla and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries.
(2) In the event of an outbreak of foot and mouth disease in animals of listed species, there is a serious risk of the spread of that disease to other establishments keeping animals of listed species.
(3) Commission Delegated Regulation (EU) 2020/687 (2) supplements the rules for the control of the listed diseases referred to in Article 9(1), points (a), (b) and (c), of Regulation (EU) 2016/429, and defined as category A, B and C diseases in Commission Implementing Regulation (EU) 2018/1882 (3).
(4) Commission Implementing Decision (EU) 2025/186 (4) was adopted on the basis of Regulation (EU) 2016/429, and it lays down certain emergency measures relating to infection with foot and mouth disease virus in Germany in response to the outbreak confirmed on 10 January 2025 in the federal state of Brandenburg, close to that state’s border with the federal state of Berlin.
(9) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
HAS ADOPTED THIS DECISION:
Germany shall ensure that:

(a) restricted zones, which comprise protection and surveillance zones are established immediately by the competent authority of that Member State in accordance with Article 21 of Delegated Regulation (EU) 2020/687, and under the conditions laid down in that Article;
(b) the protection and surveillance zones referred to in point (a) comprise at least the areas listed in Annex I to this Decision;
(c) the measures required to be applied in the protection, and surveillance zones, are applied at least until the dates listed in Annex I to this Decision.

Germany shall apply the measures which are applicable to further restricted zones, as provided for in Delegated Regulation (EU) 2020/687, in the area listed in Annex II to this Decision, and until the dates set out therein.
Implementing Decision (EU) 2025/186 is repealed.
This Decision is addressed to the Federal Republic of Germany.
