Commission Implementing Decision (EU) 2025/1881 of 11 September 2025 amending the period of application and the Annex to Implementing Decision (EU) 2023/2447 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States (notified under document C(2025) 6288)

Official Journalof the European Union ENL series
2025/1881 16.9.2025
(1) Highly pathogenic avian influenza (HPAI) is an infectious viral disease in birds and can have a severe impact on the profitability of poultry farming causing disturbance to trade within the Union and exports to third countries. HPAI viruses can infect migratory birds, which can then spread these viruses over long distances during their autumn and spring migrations. Therefore, the presence of HPAI viruses in wild birds poses a continuous threat for the direct and indirect introduction of these viruses into holdings where poultry or captive birds are kept. In the event of an outbreak of HPAI, there is a risk that the disease agent may spread to other holdings where poultry or captive birds are kept.
(2) Regulation (EU) 2016/429 establishes the legislative framework for the prevention and control of diseases that are transmissible to animals or humans. HPAI falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687(2)supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI.
(3) Commission Implementing Decision (EU) 2023/2447(3)was adopted on the basis of Regulation (EU) 2016/429, and it lays down emergency measures at Union level in relation to outbreaks of HPAI.
(4) In particular, Implementing Decision (EU) 2023/2447 provides that the protection, surveillance, and further restricted zones, to be established, following outbreaks of HPAI, by the Member States listed in the Annex thereto, in accordance with Delegated Regulation (EU) 2020/687, must comprise at least the areas listed as protection, surveillance, and further restricted zones in that Annex. Implementing Decision (EU) 2023/2447 also provides that the measures to be applied in those zones, in accordance with that Delegated Regulation, must be maintained until at least the dates set out in the Annex to that Implementing Decision.
(5) The Annex to Implementing Decision (EU) 2023/2447 was recently amended by Commission Implementing Decision (EU) 2025/1777(4)following outbreaks of HPAI in Bulgaria in establishments where poultry were kept, which needed to be reflected in that Annex.
(6) Since the date of adoption of Implementing Decision (EU) 2025/1777, Germany, Spain and Portugal have notified the Commission of outbreaks of HPAI in establishments where poultry were kept, located in the state of Schleswig-Holstein in Germany, in the province of Huelva in Spain and in the district of Santarém in Portugal.
(7) Following those outbreaks, Germany, Spain and Portugal have taken the disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around the outbreaks.
(8) The Commission has examined the disease control measures taken by Germany, Spain and Portugal and it is satisfied that the boundaries of the protection and surveillances zones established by those Member States are at a sufficient distance from the establishments where the outbreaks of HPAI have been confirmed.
(9) In the Annex to Implementing Decision (EU) 2023/2447, there are currently no areas listed as protection and surveillance zones for Germany and there are no areas listed as protection zones for Spain and Portugal.
(10) In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly lay down at Union level, in collaboration with Germany, Spain and Portugal, the protection and surveillance zones established by those Member States, in accordance with Delegated Regulation (EU) 2020/687.
(11) Therefore, the areas listed as surveillance zones for Spain and Portugal in the Annex to Implementing Decision (EU) 2023/2447 should be amended, to take account of the boundaries of the surveillance zones established by those Member States following the recent outbreaks in those Member States, as well as the required duration of the measures to be applicated in the surveillance zones, in accordance with Delegated Regulation (EU) 2020/687.
(12) In addition, the protection and surveillance zones established by Germany, and the protection zones established by Spain and Portugal, as well as the duration of the measures required to be applied in those zones, in accordance with Delegated Regulation (EU) 2020/687, should be set out in the Annex to Implementing Decision (EU) 2023/2447.
(13) Accordingly, the Annex to Implementing Decision (EU) 2023/2447 should be amended to update regionalisation at Union level in order to take account of the protection and surveillance zones established by Germany, Spain and Portugal, in accordance with Delegated Regulation (EU) 2020/687, as well as to set out the duration of the measures applicable therein.
(14) In addition, Implementing Decision (EU) 2023/2447 applies until 30 September 2025. However, the duration of the restrictions applicable in the protection zone established by Portugal and the surveillance zones established by Germany, Spain and Portugal in accordance with Delegated Regulation (EU) 2020/687 extends beyond 30 September 2025.
(15) Moreover, due to the ongoing findings of HPAI viruses in wild birds in the Union, and particularly the risks of the spread of that disease by migratory wild birds during the upcoming migration seasons, there is an increasing risk of further outbreaks in poultry and captive birds.
(16) It is therefore appropriate to prolong the period of application of Implementing Decision (EU) 2023/2447 until 30 September 2026, to cover the upcoming annual migration seasons of migratory wild birds. This prolongation also takes into account current developments in the epidemiological situation in the Union as regards HPAI and the corresponding risks to animal health resulting from possible further outbreaks of that disease.
(17) Implementing Decision (EU) 2023/2447 should therefore be amended accordingly.
(18) Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI, it is important that the amendments to be made to Implementing Decision (EU) 2023/2447 by this Decision take effect as soon as possible.
(19) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
1. in Article 5, the date ‘30 September 2025’ is replaced by the date ‘30 September 2026’;
2. the Annex is replaced by the text set out in the Annex to this Decision.

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (c), thereof,
Whereas:
In addition, Commission Delegated Regulation (EU) 2020/687 (2) supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI.
(3) Commission Implementing Decision (EU) 2023/2447 (3) was adopted on the basis of Regulation (EU) 2016/429, and it lays down emergency measures at Union level in relation to outbreaks of HPAI.
(5) The Annex to Implementing Decision (EU) 2023/2447 was recently amended by Commission Implementing Decision (EU) 2025/1777 (4) following outbreaks of HPAI in Bulgaria in establishments where poultry were kept, which needed to be reflected in that Annex.
(19) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
HAS ADOPTED THIS DECISION:
Implementing Decision (EU) 2023/2447 is amended as follows:
1. in Article 5, the date ‘30 September 2025’ is replaced by the date ‘30 September 2026’;

2. the Annex is replaced by the text set out in the Annex to this Decision.

This Decision is addressed to the Member States.

(7) Pursuant to Article 54(2) of Regulation (EU) No 1306/2013, 50 % of the financial consequences of non-recovery of irregularities is to be borne by the Member State concerned, if the recovery has not taken place within four years from the date of the recovery request, or within eight years where the recovery is taken in the national courts. Article 54(4) of Regulation (EU) No 1306/2013 requires Member States to attach to the annual accounts that they are to submit to the Commission, pursuant to Article 29 of Implementing Regulation (EU) No 908/2014, a certified table reflecting the amounts to be borne by them under Article 54(2) of Regulation (EU) No 1306/2013. Rules on the application of the Member States’ obligation to report the amounts to be recovered are laid down in Implementing Regulation (EU) No 908/2014. Annex II to Implementing Regulation (EU) No 908/2014 sets out the model of the table that Member States are to use to provide information about amounts to be recovered. On the basis of the tables completed by the Member States, the Commission is to decide on the financial consequences of non-recovery of irregularities older than four or eight years respectively.
(8) Pursuant to Article 54(3) of Regulation (EU) No 1306/2013, on duly justified grounds, Member States may decide not to pursue recovery. Such a decision may be taken only if the costs already, and likely to be incurred, total more than the amount to be recovered, or if the recovery proves impossible owing to the insolvency, recorded and recognised under national law, of the debtor or the persons legally responsible for the irregularity. If the decision has been taken within four years from the date of the recovery request, or within eight years where the recovery is taken in the national courts, 100 % of the financial consequences of the non-recovery should be borne by the Union budget. The amounts for which a particular Member State decided not to pursue recovery and the grounds for its decision are to be included in the summary report referred to in Article 54(4) of that Regulation. Therefore, such amounts should not be charged to the Member States concerned and are consequently to be borne by the Union budget.
(9) In accordance with Article 75(1), fourth subparagraph, of Regulation (EU) No 1306/2013, the rules on payment deadlines for measures under rural development in the context of the integrated administration and control system apply from claim year 2019. The reductions for non-compliance with the latest payment deadlines, calculated in accordance with Article 5a of Delegated Regulation (EU) No 907/2014, follow the procedure laid down in Articles 40 and 41 of Regulation (EU) No 1306/2013 and are to be taken into account in this Decision for the financial year 2020. Those reductions may be examined, where appropriate, under conformity clearance proceedings pursuant to Article 52 of Regulation (EU) No 1306/2013.
(10) In accordance with Article 83 of Regulation (EU) No 1303/2013 of the European Parliament and of the Council(7), the deadline for interim payments referred to in Article 36(5) of Regulation (EU) No 1306/2013 may be interrupted for a maximum period of six months in order to carry out additional verifications following information that these payments are linked to an irregularity having serious financial consequences. In adopting this Decision, the Commission should consider the amounts affected by such interruption in order to avoid making any inappropriate or untimely payments.
(11) Pursuant to Article 41 of Regulation (EU) No 1306/2013, the Commission has already reduced or suspended a number of interim payments for financial year 2020 due to expenditure not effected in accordance with Union rules. In this Decision, the Commission should consider such amounts reduced or suspended on the basis of Article 41 of that Regulation, in order to avoid making any undue or untimely payments or reimbursements that could later be subject to a financial correction.
(12) This Decision should also take into account the amounts that are still to be charged to the Member States as a result of the application of Article 54(2) of Regulation (EU) No 1306/2013 in relation to the 2007–2013 programming period for the EAFRD.
(13) In accordance with Article 51 of Regulation (EU) No 1306/2013, this Decision should be without prejudice to the decisions the Commission may take subsequently to exclude from Union financing expenditure not effected in accordance with Union rules,

Commission Implementing Decision (EU) 2025/1875 of 16 September 2025 on the clearance of the accounts of the paying agency in the Netherlands concerning expenditure financed by the European Agricultural Guarantee Fund (EAGF) for financial year 2021 (notified under document C(2025) 6214)

Official Journalof the European Union ENL series
2025/1875 18.9.2025
(1) Article 104(1), second subparagraph, point (a), of Regulation (EU) 2021/2116 provides that Article 4(1), point (b), Article 5, Article 7(3), Articles 9, 17, 21 and 34, Article 35(4), Articles 36, 37, 38, 40 to 43, 51, 52, 54, 56, 59, 63, 64, 67, 68, 70 to 75, 77, 91 to 97, 99 and 100, Article 102(2) and Articles 110 and 111 of Regulation (EU) No 1306/2013 continue to apply, as regards the European Agricultural Guarantee Fund (EAGF), in relation to expenditure incurred and payments made for the financial year 2021.
(2) Article 64, second paragraph, point (a), of Commission Implementing Regulation (EU) 2022/128(3)provides that Article 2, Article 3(1), first subparagraph, Article 3(2), Article 4(1), point (b), Articles 5, 6 and 7, Articles 21 to 25, Articles 27, 28 and 29, Article 30(1), points (a), (b) and (c), Article 30(2), (3) and (4), and Articles 31 to 40 of Commission Implementing Regulation (EU) No 908/2014(4)continue to apply, as regards the EAGF, in relation to expenditure incurred and payments made for the financial year 2021.
(3) Article 64, second paragraph, point (c), of Implementing Regulation (EU) 2022/128 provides that Annexes II and III to Implementing Regulation (EU) No 908/2014 continue to apply for the purposes of Article 32, points (f) and (g), of Implementing Regulation (EU) 2022/128 for the financial year 2021.
(4) Commission Implementing Decision (EU) 2022/820(5)cleared the accounts of the Member States’ paying agencies concerning expenditure financed by the European Agricultural Guarantee Fund (EAGF) for financial year 2021, except for the Dutch paying agency ‘Rijksdienst voor Ondernemend Nederland’.
(5) Following the transmission of new information, and after additional checks, the Commission can take a decision on the completeness, accuracy and veracity of the accounts submitted by the Dutch paying agency ‘Rijksdienst voor Ondernemend Nederland’ as regards the expenditure financed by the EAGF for financial year 2021.
(6) Article 33(2), first subparagraph, of Implementing Regulation (EU) No 908/2014 provides that the amounts that are recoverable from, or payable to, each Member State, in accordance with the accounts clearance decision referred to in Article 33(1) of that Implementing Regulation, are to be established by deducting the monthly payments for the financial year concerned, from the expenditure recognised for that year, in accordance with that Article 33(1). The Commission is to deduct that amount from or add it to the monthly payment relating to the expenditure effected in the second month following the clearance of accounts decision.
(7) Pursuant to Article 40, first subparagraph, of Regulation (EU) No 1306/2013 in conjunction with Article 5(1) of Commission Delegated Regulation (EU) No 907/2014(6), where payments have been made after the latest possible date of payment, the Commission is to reduce the amount of the monthly payments granted to the Member States and adjust the financial impact of the reduction in proportion to the delay in payment by applying the different rates provided for in Article 5(2) and (3) of Delegated Regulation (EU) No 907/2014. In accordance with Article 5(5), second subparagraph, of Delegated Regulation (EU) No 907/2014, any overrun of payment deadlines is to be taken into account, at the latest, in the accounts clearance decision. Some of the expenditure declared by the Member State concerned during the financial year 2021 was effected after the applicable deadlines. This Decision should therefore fix the relevant reductions.
(8) The Commission has already reduced the relevant monthly payments for the financial year 2021 for the amounts due to the EAGF as a result of financial and conformity clearance decisions for the Member State concerned, pursuant to Articles 51 and 52 of Regulation (EU) No 1306/2013 executed by the Commission in the financial year 2020. Any such amounts are considered in this Decision.
(9) Pursuant to Article 54(2) of Regulation (EU) No 1306/2013, 50 % of the financial consequences of the non-recovery of irregularities is to be borne by the Member State concerned, if the recovery has not taken place within four years from the date of the recovery request, or within eight years where the recovery is taken in the national courts. On the basis of the tables completed by the Member States, the Commission is to decide on the financial consequences of the non-recovery of irregularities older than four or eight years respectively.
(10) Pursuant to Article 54(3) of Regulation (EU) No 1306/2013, on duly justified grounds, Member States may decide not to pursue recovery. Such a decision may be taken only if the costs already incurred, and likely to be incurred, total more than the amount to be recovered, or if the recovery proves impossible owing to the insolvency, recorded and recognised under national law, of the debtor or the persons legally responsible for the irregularity.
(11) In clearing the accounts of the paying agency concerned, the Commission is to take account of the amounts already withheld from the Member State concerned on the basis of Implementing Decision (EU) 2022/820 notified under document C(2022) 3307.
(12) In accordance with Article 51 of Regulation (EU) No 1306/2013, this Decision should be without prejudice to the decisions the Commission may take subsequently to exclude from Union financing expenditure not effected in accordance with Union rules,

(2) Article 64, second paragraph, point (a), of Commission Implementing Regulation (EU) 2022/128 (3) provides that Article 2, Article 3(1), first subparagraph, Article 3(2), Article 4(1), point (b), Articles 5, 6 and 7, Articles 21 to 25, Articles 27, 28 and 29, Article 30(1), points (a), (b) and (c), Article 30(2), (3) and (4), and Articles 31 to 40 of Commission Implementing Regulation (EU) No 908/2014 (4) continue to apply, as regards the EAGF, in relation to expenditure incurred and payments made for the financial year 2021.
(4) Commission Implementing Decision (EU) 2022/820 (5) cleared the accounts of the Member States’ paying agencies concerning expenditure financed by the European Agricultural Guarantee Fund (EAGF) for financial year 2021, except for the Dutch paying agency ‘Rijksdienst voor Ondernemend Nederland’.
(7) Pursuant to Article 40, first subparagraph, of Regulation (EU) No 1306/2013 in conjunction with Article 5(1) of Commission Delegated Regulation (EU) No 907/2014 (6), where payments have been made after the latest possible date of payment, the Commission is to reduce the amount of the monthly payments granted to the Member States and adjust the financial impact of the reduction in proportion to the delay in payment by applying the different rates provided for in Article 5(2) and (3) of Delegated Regulation (EU) No 907/2014.
(11) In clearing the accounts of the paying agency concerned, the Commission is to take account of the amounts already withheld from the Member State concerned on the basis of Implementing Decision (EU) 2022/820 notified under document C(2022) 3307.
(12) In accordance with Article 51 of Regulation (EU) No 1306/2013, this Decision should be without prejudice to the decisions the Commission may take subsequently to exclude from Union financing expenditure not effected in accordance with Union rules,
HAS ADOPTED THIS DECISION:
The accounts of the Dutch paying agency ‘Rijksdienst voor Ondernemend Nederland’ are hereby cleared as regards expenditure financed by the European Agricultural Guarantee Fund (EAGF), in respect of financial year 2021.
The amounts recoverable from or payable to the Netherlands pursuant to this Decision, including the amounts resulting from the application of Article 54(2) of Regulation (EU) No 1306/2013, are set out in the Annex to this Decision.
This Decision is without prejudice to future conformity clearance decisions that the Commission may take pursuant to Article 52 of Regulation (EU) No 1306/2013 to exclude from Union financing expenditure not effected in conformity with Union rules.
This Decision is addressed to the Kingdom of the Netherlands.

Mandate letter for the European Coordinator for

the Rhine – Danube European Transport Corridor

Regulation (EU) 2024/1679 of the European Parliament and of the Council (1) provides for the appointment of European Coordinators responsible for implementation of the European Transport Corridors and of the two horizontal priorities, namely the European Maritime Space and the European Railway Traffic Management System (ERTMS).
The corridor approach allows an efficient cooperation between key actors in the management of both cross-border and national projects with a European relevance located on the corridor. The European Transport Corridors encompass all transport modes, aiming to increase the wide-scale efficiency of the European transport system. Therefore, deploying the European Transport Corridors plays a major part in reaching the Union political goals of a sustainable transport transition and strengthening the European economy.
You have accepted responsibility as the European Coordinator for the Rhine – Danube Corridor. Starting in the northern German ports of Wilhelmshaven, Bremen, Hamburg and Rostock, several multimodal axes leading towards Berlin, Hannover, Leipzig and Dresden, and on to Prague, where the Northern corridor axis meets with the more Western axis that starts in the French city of Strasbourg and moves on to the German cities of Frankfurt and Stuttgart and continues east to Prague and Munich respectively. It then leads via Austria, Slovakia and Hungary to the Romanian ports of Constanta and Galati. The axis providing a corridor connection to Slovakia further extends as far as Lviv in Ukraine. It covers rail, road, airports, ports, rail-road terminals and the inland waterway system of the Elbe main river, the Elbe Lateral Canal, a part of the Elbe Mittellandkanal, Weser, the Geesthacht Schleusenkanal and Vltava river in the northern part of the corridor and the Main, the Main-Danube Canal, the entire Danube downstream of Kelheim and the Váh, Sava and Tisza rivers. The key projects are removing the navigation bottlenecks along the Danube and other inland waterways as well as the railway cross-border sections Dresden – Prague, Prague – Vienna / Bratislava – Budapest and Budapest – Bucharest, as well as major national sections, including Stuttgart – Ulm.
The Commission is convinced that your support, on which it is counting enormously, will be crucial for the continued success of the European Transport Corridors and horizontal priorities.

Mission

The work of the European Coordinator aims to advance the overall development of the corridor through targeted coordination activities, notably in relation to project investment (synchronisation of works, allocation of national and Union funding) and, as appropriate, other specific actions to promote a competitive and resource-efficient transport system. Mandate letter for the European Coordinator for

the Baltic Sea – Black Sea – Aegean Sea European Transport Corridor

Regulation (EU) 2024/1679 of the European Parliament and of the Council (4) provides for the appointment of European Coordinators responsible for the implementation of the European Transport Corridors and of the two horizontal priorities namely the European Maritime Space and the European Railway Traffic Management System (ERTMS).
The corridor approach allows efficient cooperation between key actors in the management of both cross-border and national projects with a European relevance located on the corridor. The European Transport Corridors encompass all transport modes, aiming to increase wide-scale efficiency in the European transport system. Therefore, deploying the European Transport Corridors plays a major part in reaching the Union political goals of a sustainable transport transition and strengthening the European economy.
You have accepted responsibility as the European Coordinator for the Baltic Sea – Black Sea – Aegean Sea European Transport Corridor. The corridor stretches in the north from Helsinki in Finland, across Estonia, Latvia and Lithuania via Gdansk and Warsaw to Southern Poland. From there, the network leads to Lviv in Ukraine and Chișinău in Moldova to the Ukrainian Black Sea port city of Odesa. Another stretch leads from Slovakia and Hungary to Romania and further connects to Bulgaria and Greece. Cyprus is further connected by a European Maritime Space link. The corridor covers rail, road, airports, ports and rail-road terminals. The key projects are the Rail Baltica project and the connection to Ukraine and Moldova.

For this purpose, the European Coordinator shall facilitate cooperation between the Member States concerned, guide the involvement of relevant stakeholders within the Corridor Forum as well as support the preparation and implementation of Commission implementing acts referred to in Article 55 of Regulation (EU) 2024/1679, on the basis of corridor work plans referred to in Article 54 of that Regulation.

—
analysing the state of compliance and supporting the coordinated implementation of the Baltic Sea – Black Sea – Aegean Sea European Transport Corridor, in accordance with trans-European transport network (TEN-T) standards;

—
in accordance with Article 54(1), and 54(2) of Regulation (EU) 2024/1679, drawing up a work plan, at the latest by 19 July 2026 and every four years thereafter, together with the Member States concerned and, where relevant, in consultation with neighbouring countries which are part of the Baltic Sea – Black Sea – Aegean Sea;

—
submitting an annual status report to the European Parliament, the Council, the Commission and the Member States concerned on the progress achieved in implementing the Baltic Sea – Black Sea – Aegean Sea European Transport Corridor; that annual status report shall focus on the progress made on key priorities and investments, describe the nature of problems encountered in their implementation and suggest solutions;

—
offering support to the Member States, and, where appropriate, relevant neighbouring countries, in implementing the work plan;

—
in accordance with Article 53(2) of Regulation (EU) 2024/1679 formally establishing and chairing the Corridor Forum, composed of infrastructure management stakeholders. The forum shall meet regularly during your mandate;

—
consulting with the Corridor Forum regarding the work plan and regularly informing the Forum on its implementation;

—
wherever necessary, setting up and chairing a number of working groups reporting to the Corridor Forum, in accordance with Article 53(4) of Regulation (EU) 2024/1679;

—
carrying out all necessary missions to the relevant capitals, regions and urban nodes situated on the transport corridor;

—
following up the implementation and coordination of the work plan and the Commission implementing act based on it as well as other specific implementing acts for cross-border sections where applicable;

—
consulting, whenever appropriate, regional and local authorities, infrastructure managers, transport operators, in particular those which are members of the rail freight governance, the supply industry, transport users and relevant stakeholders in relation to the work plan and its implementation;

—
reporting to the Member States, the Council, the neighbouring countries that are part of the Baltic Sea – Black Sea – Aegean Sea European Transport Corridor, the European Parliament and the Commission, as well as any other entities involved in the development of the Baltic Sea – Black Sea – Aegean Sea European Transport Corridor, on difficulties encountered and proposed solutions;

—
cooperating closely with Member States and the rail freight governance to identify priorities and investment needs for rail freight on the rail freight lines of the Baltic Sea – Black Sea – Aegean Sea European Transport Corridor, taking into account the benefits provided to the trans-European transport network and the overall completion dates as set out in Regulation (EU) 2024/1679, without prejudice to the competence of the rail freight governance under Regulation (EU) No 913/2010 of the European Parliament and of the Council (5) and the competence of the Member States with respect to management and financing of infrastructure;

—
monitoring the performance of rail freight services, and identifying potential barriers, such as technical, administrative and operational ones, with a particular focus on the cross-border dimension, and making recommendations in this regard where relevant;

Commission Implementing Decision (EU) 2025/1847 of 15 September 2025 laying down rules for the application of Directive (EU) 2016/797 of the European Parliament and of the Council as regards a request from Denmark not to apply the requirement regarding the railway track resistance to applied loads set out in Commission Regulation (EU) No 1299/2014 (notified under document C(2025) 6199)

Official Journalof the European Union ENL series
2025/1847 17.9.2025
(1) On 27 September 2022, Denmark submitted to the Commission a request for non-application of point 4.2.6 of the Annex to Commission Regulation (EU) No 1299/2014(2)to a specific section of tracks 2, 3 and 5 at Slagelse Station, within a speed upgrade project, until 10 October 2036 (the ‘request’). The request was submitted on the basis of Article 7(1), point (c), of Directive (EU) 2016/797.
(2) Point 4.2.6 of the Annex to Regulation (EU) No 1299/2014 sets out the requirement related to track resistance to applied loads. In particular, point 4.2.6.2.1 sets out that the track shall be designed to withstand longitudinal forces equivalent to the force arising from braking of 2,5 m/s2for the performance parameters chosen in accordance with point 4.2.1 of that Regulation.
(3) The request concerns a special track superstructure with low construction height that was installed in 2020 in a section of tracks 2, 3, and 5 above the platform tunnel at Slagelse Station located at TIB 1 km 92,95. The special track superstructure (‘Dtz’) is approved in Denmark. The compliance with the requirement of point 4.2.6.2.1 of the Annex to Regulation (EU) No 1299/2014 is not possible to be demonstrated due to the specificities of the special track superstructure.
(4) According to the documents submitted by Denmark, complying with point 4.2.6 of the Annex to Regulation (EU) No 1299/2014 would entail an additional cost of EUR 18 to 21 million, as the installation of a new track superstructure fulfilling the requirements in point 4.2.6 would also require either raising the height of the platforms or the construction of a new tunnel to accommodate the structural height of such a track superstructure.
(5) As an alternative measure, Denmark proposes to continue to use, during the period until 10 October 2036, Dtz, in accordance with national technical specifications on track parameters Banenorm BN1-6-6, Banenorm BN1-66-2, Banenorm BN1-38-6, Sporregler 1987 and technical specification no. 7795 Version 01.02.
(6) Based on the justification for the request provided by Denmark and the alternative provisions proposed, the conditions set out in Article 7(1), point (c), and Article 7(4) of Directive (EU) 2016/797 can be considered as fulfilled for the specific section of tracks 2, 3 and 5 at Slagelse Station, within a speed upgrade project. The request should therefore be accepted.
(7) Safety, as set out by Directive (EU) 2016/797, is an essential requirement which is to be met by the Union rail system, the subsystems and the interoperability constituents, including interfaces. The Commission should therefore be provided with any information indicating that the non-application of point 4.2.6 of the Annex to Regulation (EU) No 1299/2014 could compromise the safety of the railway system.
(8) The measures provided for in this Decision are in accordance with the opinion of the Committee referred to in Article 51(1) of Directive (EU) 2016/797,
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive (EU) 2016/797 of the European Parliament and of the Council of 11 May 2016 on the interoperability of the rail system within the European Union (1), and in particular Article 7(4) thereof,

The request was submitted on the basis of Article 7(1), point (c), of Directive (EU) 2016/797.

HAS ADOPTED THIS DECISION:
The request of Denmark for non-application of point 4.2.6 of the Annex to Regulation (EU) No 1299/2014 to the specific section of the renewal project of tracks 2, 3 and 5 at Slagelse Station, within a speed upgrade project, is accepted on the condition that the alternative measure proposed by Denmark is applied.
Denmark shall without undue delay inform the Commission in case it has information that the non-application may reasonably compromise the safety of the railway system.
This Decision is addressed to the Kingdom of Denmark.
It shall apply until 10 October 2036.
