Commission Decision (EU) 2025/2024 of 9 October 2025 on the rules of procedure of the panel referred to in Article 145 of Regulation (EU, Euratom) 2024/2509 of the European Parliament and of the Council

Official Journalof the European Union ENL series
2025/2024 10.10.2025
(1) Regulation (EU, Euratom) 2024/2509 has replaced Regulation (EU, Euratom) 2018/1046 of the European Parliament and of the Council(3), providing for an independent panel as set out in Article 145 thereof, to assess certain situations of exclusion of persons and entities referred to in Article 137(2) of Regulation (EU, Euratom) 2024/2509 and to adopt appropriate recommendations (‘the Panel’) for the purposes of the proceedings to be carried out under the early detection and exclusion system (‘the EDES proceedings’).
(2) Decision (EU) 2018/1220 laid down the rules of procedure of the Panel pursuant to Article 143(4) of Regulation (EU, Euratom) 2018/1046, applicable from the date of entry into force of that Regulation to ensure, inter alia, that the rights of defence of persons or entities who are the subject to EDES proceedings, including their right to be heard, are respected.
(3) Article 145 of Regulation (EU, Euratom) 2024/2509 replaced Article 143 of Regulation (EU, Euratom) 2018/1046 setting out the rules for establishing the composition of the Panel, clarifying the role of vice-chair and the procedure for appointing the chair and vice-chair, as well as preventing and addressing conflicts of interests.
(4) Article 145(2) and (4) of Regulation (EU, Euratom) 2024/2509 empowers the Commission to adopt the Panel’s rules of procedure and for the Panel to be assisted by a permanent secretariat provided by the Commission.
(5) To ensure the Panel’s continuity and proper functioning, it is appropriate to specify the procedure for the appointment and dismissal of the chair and vice-chair and to lay down the rules under which the vice-chair is to act as chair where the chair is absent or prevented from attending to his or her duties.
(6) To ensure the Panel’s continuity and proper functioning, it is necessary to lay down detailed rules on its composition in any given case, in particular those relating to the designation of the two permanent representatives of the Commission, their deputies and the additional member representing the authorising officer responsible.
(7) It is necessary to specify which observers should participate in the Panel’s meetings to ensure that the Panel is fully and adequately informed and supported in carrying out its tasks and making its determinations.
(8) In the interests of proper administration, it is appropriate to specify the support functions to be provided to the Panel by its permanent secretariat in the framework of the EDES proceedings.
(9) The procedure for referring a case to the Panel should be clarified, in particular as regards the necessary content of the referral.
(10) Article 138(8) of Regulation (EU, Euratom) 2024/2509 provides for the possibility of an expedited procedure, the conditions on which this procedure is to be used should be specified in the Panel’s rules of procedure.
(11) Experience has shown that, in order to reduce the duration of the EDES proceedings in exceptional public procurement cases where strict deadlines apply and procedures may only be suspended for a limited time, the Panel may adopt an abridged recommendation setting out only a succinct reasoning, without the need of addressing all the issues raised during the adversarial procedure(4). Abridged recommendations may be adopted only where the Panel intends to recommend the responsible authorising officer to not adopt any exclusion or financial penalty, or to recommend lifting an existing exclusion or financial penalty.
(12) It is appropriate to specify the practical arrangements for close cooperation between the Panel and the European Anti-Fraud Office (OLAF) and between the Panel and the European Public Prosecutor’s Office (EPPO) in light of the administrative arrangements on cooperation and timely exchange of information between the Commission and those bodies.
(13) Decision (EU) 2018/1220 has been revised and renumbered on several occasions. It is therefore appropriate to repeal that Decision and replace it with a new Commission Decision.
(14) In this context, it is also appropriate to further clarify the rules for the adoption of the Panel’s recommendations and opinions.
(15) Any processing of personal data by the Panel and its permanent secretariat should be carried out in accordance with Regulation (EU) 2018/1725 of the European Parliament and of the Council(5).
(16) Regulation (EC) 1049/2001 of the European Parliament and of the Council(6)should apply to the recommendations adopted by the Panel,

(k) transmit documents and communications on behalf of the Panel to persons or entities subject to the proceeding, including the letter containing the alleged facts and findings and the preliminary classification in law of the conduct;

Forms of procedure

Matters before the Panel may be decided either in a meeting of the Panel or by written procedure.

Meetings of the Panel

Meetings of the Panel may be convened by the chair for the purpose of:

(a) establishing the preliminary classification in law of a conduct pursuant to Article 138(3) of Regulation (EU, Euratom) 2024/2509 with a view to notifying the persons or entities who are the subject of a request for a recommendation thereof;
(b) adopting a recommendation as referred to in Article 145(6) of Regulation (EU, Euratom) 2024/2509; or
(c) dealing with any questions relating to the Panel’s functioning.

Written procedure

On the initiative of the chair or at the request of another member of the Panel, the facts and findings and the preliminary classification in law of the conduct may be established, and the recommendation may be adopted, by written procedure. Any member of the Panel may object to the use of the written procedure. Observers shall be associated with this procedure.

Expedited procedure

In cases where the nature or circumstances of the case so require, the Panel may decide to expedite the procedure at the request of the authorising officer or on its own initiative. In such cases, the Panel shall endeavour to:

(a) treat the case with priority and transmit the adversarial letter referred to in Article 16 to the person or entity subject to the proceeding within 30 working days of receiving the request for a recommendation; and
(b) adopt the recommendation within 20 working days from the expiration of the time limit for submitting observations on the adversarial letter referred to in Article 16.

The right to be heard

1. Persons or entities who are the subject of a request for a recommendation shall have the right to submit observations, unless exceptional circumstances exist in which there are compelling legitimate grounds to preserve the confidentiality of an investigation or national judicial proceedings that would require that right to be deferred until such legitimate grounds cease to exist, as provided for in the second sentence of Article 145(5) of Regulation (EU, Euratom) 2024/2509.
2. In adopting its recommendations, the Panel shall consider only facts and findings and preliminary classifications in law of conduct in respect of which the person or entity who is the subject of the request for a recommendation has been able to submit observations except in cases where the second sentence of Article 145(5) of Regulation (EU, Euratom) 2024/2509 applies.

3. Before adopting a recommendation, the chair, acting at the direction of the Panel in accordance with Article 17(1), shall send to the person or entity who is the subject of the request for a recommendation a letter disclosing the facts and findings considered by the Panel and the preliminary classification in law of the conduct (an ‘adversarial letter’), subject to the provisions of Article 145(5) of Regulation (EU, Euratom) 2024/2509. In principle, this letter shall be sent by email.

4. The addressee of an adversarial letter shall submit any observations on that adversarial letter, including any annexes or attachments to those observations, in writing in the form of electronic files that may be opened using commonly available office productivity software. The observations shall be submitted to the permanent secretariat at the email address given in the letter.

5. The length of observations, excluding annexes, shall not exceed the number of pages of the adversarial letter, excluding annexes, except in duly justified cases involving complex legal or factual issues.

6. As a general rule addressees of adversarial letters shall have fifteen working days to submit observations on the adversarial letter. This period shall start according to the rules set out in Article 146 of Regulation (EU, Euratom) 2024/2509.
7. Where the addressee of an adversarial letter presents a reasoned request for the time limit for submitting observations on the adversarial letter to be extended due to exceptional circumstances, the Panel may extend the time limit by no more than half of the period initially granted.

8. Where a person or entity who is the subject of a request for a recommendation has not submitted observations on the adversarial letter by the applicable deadline despite the notification of the adversarial letter in accordance with Article 146 of Regulation (EU, Euratom) 2024/2509, the Panel may infer that that person or entity does not contest the facts or preliminary classifications in law set out in that adversarial letter.

Adoption and notification of adversarial letters and recommendations

1. The members of the Panel shall endeavour to reach a consensus on the content of adversarial letters and, subsequently, on the recommendation.

2. In the absence of a consensus, the matter shall be put to a majority vote in which:
(a) the chair has one vote;
(b) the two permanent representatives of the Commission together have one vote; if there is no agreement between them, the one vote is a negative one;
(c) the member representing the referring authorising officer has one vote.

3. The Panel shall notify its recommendation to the referring authorising officer and the observers.

Abridged recommendations

In exceptional public procurement cases where strict deadlines apply and the procedure may only be suspended for a limited time, where the Panel recommends against adopting administrative measures or recommends lifting existing administrative measures, the Panel may adopt an abridged recommendation. The following conditions shall apply.

(a) Abridged recommendations may only be adopted in case the Panel envisages recommending to not adopt any exclusion decision or any decision imposing financial penalties on a person or entity or recommending the lifting an existing exclusion decision or of a decision imposing financial penalties.
(b) The authorising officer shall not adopt an exclusion decision or a decision imposing financial penalties on a person or entity on the basis of an abridged recommendation. Where the authorising officer envisages taking a more severe decision than what has been recommended by the Panel, such decision shall be taken in accordance with Article 145(6), second subparagraph of Regulation (EU, Euratom) 2024/2509.

(c) Recommendations in abridged form must set out the facts and main reasons for the Panel’s conclusions but do not need to address all issues raised in the request for recommendation or in the observations on the adversarial letter.

Procedure for the adoption of recommendations

1. Once the permanent secretariat has verified the request for a recommendation and has examined the case as provided for in Article 7, it shall send it to the chair and the members of the Panel. The chair shall verify the preparation of the file, after requesting additional measures of verification or examination, where necessary.

2. Proceedings before the Panel in relation to a request for a recommendation shall be opened when the Panel has concluded that the evidence in the file is sufficient to allow it to establish a preliminary classification in law of the conduct and shall be deemed to be closed once the Panel has notified its recommendation to the referring authorising officer or the referring authorising officer has withdrawn its request for a recommendation.

3. The Panel shall endeavour, in principle, to deliver its recommendations to referring authorising officers within a reasonable period after the opening of proceedings, taking into account the need to ensure that the right to be heard is respected.

Confidentiality of the proceedings and deliberations

Without prejudice to the application of Article 8(1) of Regulation (EU, Euratom) No 883/2013 and Article 22a of the Staff Regulations (9), the members of the Panel and of its permanent secretariat, as well as any persons who have participated in any capacity in the proceedings or meetings of the Panel or have been involved in preparing the documents, opinions or positions issued by it, shall comply with the strictest confidentiality in this respect, in accordance with their possible administrative or contractual liability or liability under the Staff Regulations. The same applies to the chair and vice-chair.

Handling of requests for access to documents and protection of personal data

Regulation (EC) No 1049/2001 and Regulation (EU) 2018/1725 apply to the proceedings of the Panel.

Principles

1. Articles 1 to 4, 8, 20 and 21 in Chapter I of these Rules of Procedure apply to the Panel’s exercise of the consultative powers conferred on it by Article 93 of Regulation (EU, Euratom) 2024/2509.
2. Other articles in Chapter I of these Rules of Procedure shall also apply to the Panel’s exercise of the powers referred to in paragraph 1, unless otherwise provided for in this Chapter.

Additional members of the Panel and their deputies

1. When issuing the opinion referred to in Article 93(1) of Regulation (EU, Euratom) 2024/2509, the Panel shall be composed of the members referred to in Article 145(2), points (a) to (c), of that Regulation and of the following three additional members:
(a) a representative of the appointing authority in charge of disciplinary matters of the Union institution, Union body, European office or body or person concerned when the case is referred in accordance with Article 93(1), first subparagraph, point (a), or a representative of the authorising officer responsible when the case is referred in accordance with Article 93(1), first subparagraph, point (b);
(b) a member appointed by the staff committee of the Union institution, Union body, European office or body or person concerned;
(c) a member of the legal service of the institution, European office set up by the Commission, executive agency or other European office, body or agency of the member of staff concerned.

2. The persons referred to in Article 5(1), second subparagraph, and Article 5(2), second subparagraph, may participate in all deliberations of the Panel, and shall only participate in voting when the permanent representative of the Commission for whom they are a deputy is unable to do so.

3. Each of the three additional members referred to in paragraph 1 shall have a deputy designated, respectively, by:
(a) the appointing authority concerned or the authorising officer responsible;
(b) the staff committee concerned;
(c) the legal service concerned.

Designation of observers

1. The Commission’s Legal Service shall designate an observer when the staff member concerned does not belong to the Commission.

2. The authorising officer responsible or, where appropriate, the Head of a Union Delegation acting as authorising officer by sub-delegation, or their representatives, shall have observer status.

3. OLAF shall designate an observer when the information relating to the alleged breach of a provision of Regulation (EU, Euratom) 2024/2509 or of any other provision relating to financial management or control of transactions results from information transmitted by OLAF.

4. The disciplinary office of the institution or body concerned shall designate an observer where a case is referred to the Panel by the appointing authority. In other cases, it may be invited by the chair to designate an observer.

5. After consulting the members, the chair may invite other observers.

Permanent secretariat of the Panel

1. Article 7, except for paragraph 2, points (k) and (o), thereof, applies for the purposes of this Chapter.

2. In particular, the permanent secretariat shall:
(a) where the Panel is directly informed of a case by a staff member, ensure that the file is sent to the appointing authority and shall notify this to the staff member who transmitted the information, as specified in Article 26(2);
(b) where a case is referred to the Panel, verify the capacity of the referring authority and of its designated representatives;
(c) identify, in agreement with the chair, the three additional members of the Panel and the observers and verify their capacity;
(d) verify that the files are complete and contain all the necessary documents and information, in particular the information sheet referred to in Article 11(4), a description of the facts and the alleged irregularity, and the supporting documents, including the investigation reports;
(e) verify that the staff member concerned has been properly heard by the appointing authority or the authorising officer responsible, as appropriate;
(f) draw up the draft opinions to be submitted for examination by the Panel and send them to the chair, to the other members and to the observers who have been called upon to participate in settling a case;
(g) send the recommendations referred to in Article 93(3) of Regulation (EU, Euratom) 2024/2509 to the authorising officer responsible and the internal audit service responsible;
(h) where the Panel considers that the case is a matter for OLAF, transmit the file to the appointing authority without delay and inform OLAF.

Referral of cases to the Panel

1. In accordance with Article 93(1) of Regulation (EU, Euratom) 2024/2509, the Panel shall be convened at the request of any appointing authority responsible for disciplinary matters or of an authorising officer responsible, including a head of a Union delegation or a deputy acting as the authorising officer by sub-delegation, hereinafter a ‘referring authority’.

2. Where the Panel is directly informed by a staff member, it shall send the file to the competent appointing authority or, as appropriate, to the authority empowered to conclude contracts and inform that staff member. If the competent appointing authority decides to refer the case to the Panel, it shall inform the staff member. If it decides not to refer the case to the Panel, it shall inform the Panel and the staff member.

3. By way of derogation from paragraph 2, in order to ensure that whistle-blowers are effectively protected, as provided for in Article 22a(3) of the Staff Regulations, the Panel may decide not to inform the competent appointing authority and to inform OLAF.

Written procedure

At the initiative of the chair or at the request of a member of the Panel, opinions may be adopted by written procedure. Any member of the Panel may object to the use of the written procedure. In that case, the chair shall convene a meeting within a reasonable time. The same rule shall apply as regards the recommendation referred to in Article 93(3) of Regulation (EU, Euratom) 2024/2509.

Adoption of opinions and recommendations

1. The Panel shall seek to reach a consensus on whether a financial irregularity has occurred and on the reasoning underlying its opinions or recommendations.

2. In the absence of a consensus, the matter shall be put to a vote in which:
(a) the chair has one vote;
(b) the two permanent representatives of the Commission together have one vote;
(c) three additional members referred to in Article 23(1) have one vote each.

3. Paragraphs 1 and 2 apply mutatis mutandis to the adoption of the recommendations. The consensus or the vote shall concern in particular the systemic nature of the issues detected.

Notification of opinions

The Panel shall notify opinions without delay to the referring authority, the authorising officer responsible and the observers. Where the EPPO has been invited as an observer, the provisions of Article 103 of Regulation (EU) 2017/1939 shall apply.

The staff member’s right to be heard

In accordance with Article 93(2) second subparagraph of Regulation (EU, Euratom) 2024/2509, before referring a case to the Panel, the appointing authority or, as applicable, the authorising officer responsible shall give the member of staff involved the opportunity to present his or her observations on the facts concerning them.

Council Decision (EU) 2025/2023 of 2 October 2025 on the position to be taken, on behalf of the European Union, within the Association Council established by the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part, as regards the amendment of Protocol 4 to that Agreement concerning the definition of the concept of ‘originating products’ and methods of administrative cooperation

Official Journalof the European Union ENL series
2025/2023 3.10.2025
(1) The Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part(1)(the ‘Association Agreement’) entered into force on 1 March 2000.
(2) The Association Agreement includes Protocol 4 concerning the definition of originating products and methods of administrative cooperation (‘Protocol 4’), which lays down the rules of origin.
(3) Pursuant to Article 39 of Protocol 4, the Association Council established by Article 78 of the Association Agreement (the ‘Association Council’) may decide to amend the provisions of Protocol 4. Pursuant to Article 80, second paragraph, of the Association Agreement, the decisions taken by the Association Council are to be binding on the Parties, which shall take the measures necessary to implement those decisions.
(4) The Association Council, during its next meeting or by exchange of letters, is to adopt a decision on a proposed amendment of Protocol 4.
(5) It is appropriate to establish the position to be taken, on behalf of the Union, within the Association Council as the decision of the Association Council will have legal effects.
(6) As a result of the judgment of the Court of Justice of the European Union (the ‘Court’) in Case C-104/16 P(2)of 21 December 2016, in order to establish a legal basis to grant the tariff preferences laid down in the Association Agreement to goods originating in Western Sahara, the Union and the Kingdom of Morocco concluded an Agreement in the form of an Exchange of Letters on the amendment of Protocols 1 and 4 to the Association Agreement(3)(the ‘Agreement in the form of an Exchange of Letters’), which was signed on 25 October 2018.
(7) As a result of the judgment of the Court in Joined Cases C-779/21 P and C-799/21 P(4)of 4 October 2024, to ensure that the flows of trade which have developed over the years are not disrupted, and that the tariff preferences under the Association Agreement apply to goods originating in Western Sahara, the European Union and Morocco negotiated a new Agreement in the form of an Exchange of Letters that replaces the Agreement in the form of an Exchange of Letters (the ‘new Agreement’). The new Agreement was signed on 3 October 2025 and has applied on a provisional basis since 4 October 2025.
(8) The Joint Declaration contained in the new Agreement, inserted after Protocol 4, specifies that products originating in Western Sahara which are subject to controls by the customs authorities of the Kingdom of Morocco benefit from the same trade preferences as those granted by the Union to the products covered by the Association Agreement, and that Protocol 4 appliesmutatis mutandisfor the purposes of defining the originating status of those products, including with regard to proof of origin.
(9) Within the framework of the new Agreement, Protocol 4 should be amended in order to ensure both its applicability to products originating in Western Sahara and the continuation of trade, in particular for the fruit and vegetables sector and the fisheries sector.
(10) The position of the Union within the Association Council should therefore be based on the attached draft Decision,
(1) Article 29 of the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part (the ‘Association Agreement’), refers to Protocol 4 to that Agreement (‘Protocol 4’), which lays down the rules of origin.
(2) Article 5 of Protocol 4 provides that the Association Council may decide to amend the provisions of Protocol 4.
(3) The Joint Declaration concerning Protocol 4 specifies that products originating in Western Sahara which are subject to controls by the customs authorities of the Kingdom of Morocco benefit from the same trade preferences as those granted by the European Union to the products covered by the Association Agreement and that Protocol 4 appliesmutatis mutandisfor the purposes of defining the originating status of these products, including with regard to proof of origin, except as provided for in decisions of the Association Council.
(4) Within the framework of the agreement in the form of an Exchange of Letters between the European Union and the Kingdom of Morocco on the amendment of Protocols 1 and 4 to the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part, concluded on … 2025.
(5) Protocol 4 should be amended in order to provide for the amendments necessary to ensure both its applicability to products originating in Western Sahara and the continuation of trade, in particular for the fruit and vegetables sector and the fisheries sector,

Council Decision (EU) 2025/2022 of 2 October 2025 on the signing, on behalf of the Union, and provisional application of the Agreement in the form of an Exchange of Letters between the European Union and the Kingdom of Morocco on the amendment of Protocols 1 and 4 to the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part

Official Journalof the European Union ENL series
2025/2022 3.10.2025
(1) On 10 September 2025, the Council authorised the Commission to open negotiations with the Kingdom of Morocco for an Agreement in the form of an Exchange of Letters between the European Union and the Kingdom of Morocco on the amendment of Protocols 1 and 4 to the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part.
(2) The Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part(1)(the ‘Association Agreement’) entered into force on 1 March 2000.
(3) In its judgment in Case C-104/16 P(2)of 21 December 2016, the Court of Justice of the European Union (the ‘Court’) clarified that the Association Agreement only covers the territory of the Kingdom of Morocco and does not cover Western Sahara, which is a non-self-governing territory that is distinct from the Kingdom of Morocco.
(4) In order to establish a legal basis to grant the tariff preferences laid down in the Association Agreement to goods originating in Western Sahara, the European Union and the Kingdom of Morocco concluded an Agreement in the form of an Exchange of Letters on the amendment of Protocols 1 and 4 to the Association Agreement(3)(the ‘Agreement in the form of an Exchange of Letters’), which was signed on 25 October 2018. The Agreement in the form of an Exchange of Letters was approved by means of Council Decision (EU) 2019/217(4).
(5) As a consequence of the Court’s judgment of 4 October 2024 in Joined Cases C-779/21 P and C-799/21 P(5), Decision (EU) 2019/217 will cease to have effect on 4 October 2025.
(6) It is important to ensure that the flows of trade which have developed over the years are not disrupted, and that the tariff preferences under the Association Agreement apply to goods originating in Western Sahara, while fully respecting the conditions laid out in the judgment of the Court in Joined Cases C-779/21 P and C-799/21 P.
(7) In successive Commission staff working documents, the Commission has taken the view that the extension of tariff preferences to products originating in Western Sahara has a direct impact concentrated in a small number of agricultural and fishery products in the territory of Western Sahara. The application of the Agreement in the form of an Exchange of Letters allowed savings of EUR 44,4 million in customs duties in 2022 on EUR 590 million worth of exported products.
(8) In its judgment in Joined Cases C-779/21 P and C-799/21 P, the Court ruled that any agreement with the Kingdom of Morocco concerning Western Sahara must have the consent of the people of Western Sahara. Moreover, the Court held that such consent may be presumed provided that the agreement in question does not give rise to any obligation for the people of Western Sahara and that that people receives a specific, tangible, substantial and verifiable benefit from the exploitation of natural resources in Western Sahara territory which is proportional to the degree of that exploitation. The benefit must be accompanied by guarantees that that exploitation is carried out under conditions consistent with the principle of sustainable development.
(9) Furthermore, in its judgment in Case C-399/22(6)of 4 October 2024, the Court clarified that the territory of Western Sahara is to be considered as a separate customs territory for the purposes of Article 60 of Regulation (EU) No 952/2013 of the European Parliament and of the Council(7)and, consequently, of Regulation (EU) No 1308/2013 of the European Parliament and of the Council(8)and Commission Implementing Regulation No 543/2011(9)as regards the indication of the country of origin on the labelling of those products harvested in that territory, which may designate only Western Sahara as such origin.
(10) In accordance with the conditions established by the Court in its judgment in Joined Cases C-779/21 P and C-799/21 P, the Commission has negotiated a new Agreement in the form of an Exchange of Letters between the European Union and the Kingdom of Morocco on the amendment of Protocols 1 and 4 to the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part (the ‘new Agreement in the form of an Exchange of Letters’), replacing the Agreement in the form of an Exchange of Letters.
(11) The new Agreement in the form of an Exchange of Letters extends the bilateral tariff preferences granted by the Association Agreement to products originating in the territory of Western Sahara which are subject to controls by the Moroccan customs authorities.
(12) In the context of the new Agreement in the form of an Exchange of Letters, the Association Council established by the Association Agreement will be called upon to adopt a decision amending Protocol 4 to the Association Agreement concerning the definition of the concept of ‘originating products’ and methods of administrative cooperation in order to lay down the provisions necessary to ensure the applicability of that Protocol to products originating in Western Sahara and the continuation of trade, in particular for the fruit and vegetables sector and for the fisheries sector.
(13) Furthermore, in order to ensure a clear distinction on labelling between, on the one hand, products of the fruit and vegetables sector originating in Western Sahara which are subject to controls by the Moroccan customs authorities and, on the other hand, products of the same sector originating in Morocco, and to ensure that Union consumers are properly informed, the new Agreement in the form of an Exchange of Letters establishes that, when imported into the Union, fruit and vegetables originating in Western Sahara which are subject to controls by the Moroccan customs authorities are identified by a reference to the region of origin of the product, as indicated on the certificate of origin accompanying those products at the time of their import into the Union. In addition, the new Agreement in the form of an Exchange of Letters provides that, in respect of fresh fruit and vegetables originating in Western Sahara which are subject to controls by the Moroccan customs authorities, the Union may grant the Moroccan authorities concerned the necessary authorisations to issue certificates of conformity proving compliance with Union marketing standards, in accordance with Union legislation.
(14) According to the declaration of the Union, to be made when the new Agreement in the form of an Exchange of Letters is signed, the Union will first provide funding for the region focusing on key sectors, such as water, including irrigation, energy, combating desertification, and desalinisation of water in line with the principle of sustainable development. The joint assessment mechanism provided for in the new Agreement in the form of an Exchange of Letters will be implemented by the parties. At the same time, the Union will increase its humanitarian aid to the Tindouf camps. That aid will be channelled through relevant Union and United Nations mechanisms, and will be subject to the same operational arrangements in place for humanitarian action. The Commission will support suitable programmes in sectors such as education, culture and skills.
(15) A regular monitoring mechanism will be established in accordance with paragraph 153 of the judgment of the Court in Joined Cases C-779/21 P and C-799/21 P, including the joint assessment mechanism.
(16) The Union supports the efforts of the United Nations to find a fair, lasting and mutually acceptable political solution that would allow the self-determination of the people of Western Sahara under agreements aligned with the principles and objectives enshrined in the Charter of the United Nations.
(17) The new Agreement in the form of an Exchange of Letters should be signed, subject to its conclusion at a later date, and the declaration of the Union to be made upon signing should be approved.
(18) The new Agreement in the form of an Exchange of Letters should be applied provisionally, pending its entry into force,
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 207(4), first subparagraph, in conjunction with Article 218(5) thereof,
Having regard to the proposal from the European Commission,
Whereas:
(1) On 10 September 2025, the Council authorised the Commission to open negotiations with the Kingdom of Morocco for an Agreement in the form of an Exchange of Letters between the European Union and the Kingdom of Morocco on the amendment of Protocols 1 and 4 to the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part.
(2) The Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part (1) (the ‘Association Agreement’) entered into force on 1 March 2000.
(3) In its judgment in Case C-104/16 P (2) of 21 December 2016, the Court of Justice of the European Union (the ‘Court’) clarified that the Association Agreement only covers the territory of the Kingdom of Morocco and does not cover Western Sahara, which is a non-self-governing territory that is distinct from the Kingdom of Morocco.
(4) In order to establish a legal basis to grant the tariff preferences laid down in the Association Agreement to goods originating in Western Sahara, the European Union and the Kingdom of Morocco concluded an Agreement in the form of an Exchange of Letters on the amendment of Protocols 1 and 4 to the Association Agreement (3) (the ‘Agreement in the form of an Exchange of Letters’), which was signed on 25 October 2018. The Agreement in the form of an Exchange of Letters was approved by means of Council Decision (EU) 2019/217 (4).
(5) As a consequence of the Court’s judgment of 4 October 2024 in Joined Cases C-779/21 P and C-799/21 P (5), Decision (EU) 2019/217 will cease to have effect on 4 October 2025.
(9) Furthermore, in its judgment in Case C-399/22 (6) of 4 October 2024, the Court clarified that the territory of Western Sahara is to be considered as a separate customs territory for the purposes of Article 60 of Regulation (EU) No 952/2013 of the European Parliament and of the Council (7) and, consequently, of Regulation (EU) No 1308/2013 of the European Parliament and of the Council (8) and Commission Implementing Regulation No 543/2011 (9) as regards the indication of the country of origin on the labelling of those products harvested in that territory, which may designate only Western Sahara as such origin.
(18) The new Agreement in the form of an Exchange of Letters should be applied provisionally, pending its entry into force,
HAS ADOPTED THIS DECISION:
The signing of the Agreement in the form of an Exchange of Letters between the European Union and the Kingdom of Morocco on the amendment of Protocols 1 and 4 to the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part, is hereby authorised on behalf of the Union, subject to the conclusion of the said Agreement (10).
The Declaration of the European Union concerning the Agreement in the form of an Exchange of Letters between the European Union and the Kingdom of Morocco on the amendment of Protocols 1 and 4 to the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part is hereby approved on behalf of the Union.
The Agreement shall be applied provisionally, in accordance with the Agreement and subject to the notifications provided for therein, pending the completion of the procedures necessary for its entry into force.
This Decision shall enter into force on the date of its adoption.

Definitions

For the purposes of this Decision:

(b) ‘tail institution’ means tail institution as defined in Article 2, point (17), of Regulation (EU) 2021/379 (ECB/2021/2).

Transitional provisions for institutions located in Bulgaria

1. In derogation from Article 8 of Regulation (EU) 2021/378 (ECB/2021/1), a transitional maintenance period shall run from 1 January to 10 February 2026 for institutions located in Bulgaria.

2. The reserve base of each institution located in Bulgaria, excluding tail institutions, for the transitional maintenance period shall be defined in relation to its balance sheet as at 31 October 2025. Българска народна банка (Bulgarian National Bank) shall request institutions located in Bulgaria to report their reserve base in accordance with Regulation (EU) 2021/379 (ECB/2021/2).

3. The reserve base of each tail institution located in Bulgaria shall be defined in relation to its balance sheet as at 30 September 2025. 4. In respect of the transitional maintenance period, either an institution located in Bulgaria or Българска народна банка (Bulgarian National Bank) shall calculate such institution’s minimum reserves. The party that calculates the minimum reserves shall submit its calculation to the other party allowing sufficient time for the latter to verify it and submit revisions. The calculated minimum reserves, including any revisions thereof, shall be confirmed by the two parties at the latest on 19 December 2025. If the notified party does not confirm the amount of minimum reserves by 19 December 2025, it shall be deemed to have acknowledged that the calculated amount applies for the transitional maintenance period.

5. Article 3(2) to (4) shall apply mutatis mutandis to institutions located in Bulgaria so that these institutions may, for their initial maintenance periods, deduct from their reserve bases any liabilities owed to institutions in Bulgaria, although at the time the minimum reserves are calculated such institutions will not appear on the list of institutions subject to minimum reserve requirements referred to in Article 3(3) of Regulation (EU) 2021/378 (ECB/2021/1).

Transitional provisions for institutions located in other Member States whose currency is the euro

1. The maintenance period applicable to institutions located in other Member States whose currency is the euro pursuant to Article 8 of Regulation (EU) 2021/378 (ECB/2021/1) shall remain unaffected by the transitional maintenance period for institutions located in Bulgaria as provided for in Article 2(1).

2. Institutions located in other Member States whose currency is the euro may decide to deduct from their reserve base for the maintenance periods from 23 December 2025 to 10 February 2026 and from 11 February to 24 March 2026 any liabilities owed to institutions located in Bulgaria, although at the time the minimum reserves are calculated such institutions will not appear on the list of institutions subject to minimum reserve requirements referred to in Article 3(3) of Regulation (EU) 2021/378 (ECB/2021/1).

3. Institutions located in other Member States whose currency is the euro that decide to deduct liabilities owed to institutions located in Bulgaria pursuant to paragraph 2 shall, for the maintenance periods from 23 December 2025 to 10 February 2026 and from 11 February to 24 March 2026, calculate their minimum reserves on the basis of their balance sheets as at 31 October 2025 and 31 December 2025 respectively and report statistical information in accordance with Part 1 of Annex III to Regulation (EU) 2021/379 (ECB/2021/2) showing institutions located in Bulgaria as already subject to the ECB’s minimum reserve system.
This shall be without prejudice to the obligation for institutions to report statistical information for the periods concerned in accordance with Table 1 in Part 2 of Annex I to Regulation (EU) 2021/379 (ECB/2021/2), still showing institutions located in Bulgaria as being banks located in the ‘Rest of the world’.
The tables shall be reported in accordance with the time limits and procedures laid down in Regulation (EU) 2021/379 (ECB/2021/2).

Commission Implementing Decision (EU) 2025/2007 of 29 September 2025 on the request for registration of the European citizens’ initiative entitled Ethical selection of European representatives, pursuant to Regulation (EU) 2019/788 of the European Parliament and of the Council (notified under document C(2025) 6500)

Official Journalof the European Union ENL series
2025/2007 2.10.2025
(1) A request for registration of a European citizens’ initiative entitled ‘Ethical selection of European representatives’ was submitted to the Commission on 30 June 2025. The aim of the initiative, as expressed by the organisers, was to call on the Commission to propose legislation ‘introducing common criteria for ethical, transparent and verifiable selection of candidates for European public office’.
(2) By letter of 28 July 2025 (C(2025) 5234 final), pursuant to Article 6(4) of Regulation (EU) 2019/788, the Commission informed the group of organisers that as regards the request for registration submitted on 30 June 2025, the requirements for registration set out in Article 6(3), first subparagraph, points (a), (d) and (e), of that Regulation were fulfilled and that Article 6(3), first subparagraph, point (b), thereof was not applicable. However, the Commission also explained that the initiative did not fulfil the requirement set out in Article 6(3), first subparagraph, point (c), of Regulation (EU) 2019/788 because the Commission does not have the power to propose legislation introducing common criteria for the selection of candidates for European public office, given that the members of the Union institutions are appointed following procedures established in primary law.
(3) The Commission therefore informed the organisers pursuant to Article 6(4), first subparagraph, of Regulation (EU) 2019/788 that they could either amend the initiative to take into account the Commission’s assessment, or maintain, or withdraw, the initial initiative in accordance with Article 6(4), second subparagraph, of Regulation (EU) 2019/788.
(4) On 29 August 2025, the group of organisers submitted an amended initiative.
(5) The aims of the amended initiative, as expressed by the organisers, are to call on the Commission to: (i) ‘issue a recommendation under Article 292 TFEU calling on the Member States and political parties to introduce minimum standards on ethics, psychological fitness and competence for the internal selection of candidates to stand in European and national elections’; (ii) adopt ‘a voluntary European Code of Ethics’ for candidates; and (iii) launch ‘a public awareness and education campaign’. An annex to the initiative provides further details on its background, its subject matter and its objectives. The organisers have also submitted a draft legal act as part of their registration request.
(6) Concerning the first measure, namely that the Commission issue a recommendation ‘calling on the Member States and political parties to introduce minimum standards on ethics, psychological fitness and competence for the internal selection of candidates to stand in European and national elections’, the Commission concludes that the initiative does not call on the Commission to submit a proposal for a legal act of the Union for the purpose of implementing the Treaties. Therefore, this measure does not fulfil the legal requirement in Article 6(3), first subparagraph, point (c), of Regulation (EU) 2019/788. Moreover, even if the registration request were to be interpreted as to cover the submission by the Commission of a proposal for a Council recommendation to introduce such minimum standards, the provisions mentioned by the organisers do not give the Union the competence to adopt such a recommendation. Furthermore, Article 223 TFEU, which grants the Council, following a proposal by the European Parliament, the competence to lay down the provisions necessary for the election of the Members of the European Parliament, grants no role to the Commission. It follows that the Commission has no power to submit a proposal for a Council recommendation to introduce minimum standards for the selection of candidates for elections.
(7) Similarly, the Commission concludes that the second and third measures, by which the organisers call on the Commission to adopt ‘a voluntary European Code of Ethics’ for candidates and to launch ‘a public awareness and education campaign’, do not call on the Commission to submit a proposal for a legal act of the Union for the purpose of implementing the Treaties. Therefore, these measures do not fulfil the legal requirement in Article 6(3), first subparagraph, point (c), of Regulation (EU) 2019/788.
(8) For those reasons, the initiative entitled ‘Ethical selection of European representatives’ manifestly falls outside the framework of the Commission’s powers to submit a proposal for a legal act of the Union for the purpose of implementing the Treaties within the meaning of Article 6(4), third subparagraph, point (c), of Regulation (EU) 2019/788.
(9) The request for registration should therefore be refused,
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2019/788 of the European Parliament and of the Council of 17 April 2019 on the European citizens’ initiative (1), and in particular Article 6(4) thereof,
Whereas:
(9) The request for registration should therefore be refused,
HAS ADOPTED THIS DECISION:
The European citizens’ initiative entitled ‘Ethical selection of European representatives’ shall not be registered.
This Decision is addressed to the group of organisers of the citizens’ initiative entitled ‘Ethical selection of European representatives’, represented by Gian Elio DE MARCO and Jean-Pierre SAULNIER acting as contact persons.

Commission Implementing Decision (EU) 2025/2000 of 29 September 2025 amending the Annex to Implementing Decision (EU) 2023/2447 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States (notified under document C(2025) 6687)

Official Journalof the European Union ENL series
2025/2000 2.10.2025
(1) Highly pathogenic avian influenza (HPAI) is an infectious viral disease in birds and can have a severe impact on the profitability of poultry farming causing disturbance to trade within the Union and exports to third countries. HPAI viruses can infect migratory birds, which can then spread these viruses over long distances during their autumn and spring migrations. Therefore, the presence of HPAI viruses in wild birds poses a continuous threat for the direct and indirect introduction of these viruses into holdings where poultry or captive birds are kept. In the event of an outbreak of HPAI, there is a risk that the disease agent may spread to other holdings where poultry or captive birds are kept.
(2) Regulation (EU) 2016/429 establishes the legislative framework for the prevention and control of diseases that are transmissible to animals or humans. HPAI falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687(2)supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including HPAI. In particular, Article 21 of that Delegated Regulation provides that in the event of an outbreak of a category A disease in an establishment, the competent authority is to immediately establish a restricted zone comprising a protection zone, a surveillance zone, and if necessary, further restricted zones around or adjacent to the protection and surveillance zones.
(3) Commission Implementing Decision (EU) 2023/2447(3)was adopted on the basis of Regulation (EU) 2016/429, and it lays down emergency measures at Union level in relation to outbreaks of HPAI.
(4) In particular, Article 2, point (a), Article 3, point (a), and Article 4, point (a) of Implementing Decision (EU) 2023/2447 provide, respectively, that following outbreaks of HPAI, the protection, surveillance, and further restricted zones to be established by the Member States listed in the Annex thereto, in accordance with Delegated Regulation (EU) 2020/687, must comprise at least the areas listed as protection, surveillance, and further restricted zones in that Annex. Article 2, point (b), Article 3, point (b), and Article 4, point (b) of Implementing Decision (EU) 2023/2447 also provide that the measures to be applied in those respective zones, in accordance with Delegated Regulation (EU) 2020/687, must be maintained until at least the dates set out in the Annex to that Implementing Decision.
(5) The Annex to Implementing Decision (EU) 2023/2447 was recently amended by Commission Implementing Decision (EU) 2025/1927(4), following outbreaks of HPAI in Germany in establishments where poultry were kept, which needed to be reflected in that Annex.
(6) Since the date of adoption of Implementing Decision (EU) 2025/1927, Spain, Poland and Portugal have notified the Commission of four new outbreaks of HPAI in establishments where captive birds or poultry were kept; one outbreak in poultry in the Valladolid province in Spain, two outbreaks in poultry located in the Warmińsko-Mazurskie voivodeship in Poland, and one outbreak in captive birds in the district of Santarém in Portugal.
(7) Following those four new outbreaks, Spain, Poland, and Portugal have taken the disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around the outbreaks.
(8) The Commission has examined the disease control measures taken by Spain, Poland, and Portugal and it is satisfied that the boundaries of the protection and surveillances zones established by those Member States are at a sufficient distance from the establishments where the outbreaks of HPAI have been confirmed.
(9) In the Annex to Implementing Decision (EU) 2023/2447, there are currently no areas listed as protection and surveillance zones for Poland.
(10) In order to prevent any unnecessary disturbance to trade within the Union and to avoid any unjustified disruptions to trade being imposed by third countries, it is necessary to rapidly lay down at Union level, in collaboration with Spain, Poland, and Portugal the protection and surveillance zones established by those Member States, in accordance with Delegated Regulation (EU) 2020/687.
(11) Therefore, the areas listed as protection and surveillance zones for Spain and Portugal in the Annex to Implementing Decision (EU) 2023/2447 should be amended, to take account of the boundaries of the protection and surveillance zones established by those Member States following the two new HPAI outbreaks in those Member States, as well as the required duration of the measures to be applicated in those zones, in accordance with Delegated Regulation (EU) 2020/687.
(12) In addition, the areas listed as protection and surveillance zones for Poland should be set out in the Annex to Implementing Decision (EU) 2023/2447, to take account of the boundaries of the protection and surveillance zones established by Poland following the two recent HPAI outbreaks in that Member State, as well as the duration of the measures required to be applied in those zones, in accordance with Delegated Regulation (EU) 2020/687.
(13) The Annex to Implementing Decision (EU) 2023/2447 should, therefore, be amended accordingly.
(14) Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI, it is important that the amendments to be made to Implementing Decision (EU) 2023/2447 by this Decision take effect as soon as possible.
(15) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (c), thereof,
Whereas:
In addition, Commission Delegated Regulation (EU) 2020/687 (2) supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including HPAI.
(3) Commission Implementing Decision (EU) 2023/2447 (3) was adopted on the basis of Regulation (EU) 2016/429, and it lays down emergency measures at Union level in relation to outbreaks of HPAI.
(5) The Annex to Implementing Decision (EU) 2023/2447 was recently amended by Commission Implementing Decision (EU) 2025/1927 (4), following outbreaks of HPAI in Germany in establishments where poultry were kept, which needed to be reflected in that Annex.
(15) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
HAS ADOPTED THIS DECISION:
The Annex to Implementing Decision (EU) 2023/2447 is replaced by the text set out in the Annex to this Decision.
This Decision is addressed to the Member States.
